This bill\u00a0<a target=\"_blank\" href=\"https:\/\/www.michaelgeist.ca\/2022\/10\/why-the-real-bill-c-18-threat-is-bill-c-18\/\" rel=\"noopener\">will reward big media conglomerates<\/a>\u00a0like Bell, while freezing out small and independent organizations.<\/p>\n<\/li>\n<\/ul>\n<p>Here comes another one,\u00a0<a target=\"_blank\" href=\"https:\/\/www.parl.ca\/DocumentViewer\/en\/44-1\/bill\/C-26\/first-reading\" rel=\"noopener\">Bill C-36: An Act respecting cyber security, amending the Telecommunications Act and making consequential amendments to other Acts,<\/a>\u00a0which passed first reading last June.<\/p>\n<p>It\u2019s been largely flying under everybody\u2019s radar so far. The Canadian Civil Liberties Association has been actively raising awareness and Michael Geist had Brenda McPhail, their Director of the Privacy, Technology and Surveillance Program\u00a0<a target=\"_blank\" href=\"https:\/\/www.michaelgeist.ca\/2022\/10\/law-bytes-podcast-episode-142\/\" rel=\"noopener\">on his podcast<\/a>\u00a0last October.<\/p>\n<\/p>\n<p>We mentioned C-26\u00a0<a target=\"_blank\" href=\"https:\/\/axisofeasy.com\/aoe\/axisofeasy-273-take-control-over-your-social-media-presence-with-mastodon\/\" rel=\"noopener\">in AxisOfEasy #273<\/a>\u00a0citing Gowling WLG\u2019s\u00a0<a target=\"_blank\" href=\"https:\/\/gowlingwlg.com\/en\/insights-resources\/articles\/2022\/bill-c-26-rights-groups-oppose-infrastructure-law\/\" rel=\"noopener\">coverage of it by Brent Arnold<\/a>\u00a0(Brent Arnold sits on the Internet Society Canada Chapter board, as do I, but I am writing this post from my role as easyDNS CEO, and not ISCC.)<\/p>\n<h2>The Government Hereby Grants Itself The Following Powers:<\/h2>\n<p>The new bill is ostensibly a cyber-security and critical infrastructure bill, but it is riddled with nebulous, open-ended terms, Kafka-esque secrecy provisions, onerous penalties and conspicuously absent of any semblance due process:<\/p>\n<p>It effectively subjects Canada\u2019s telecom and internet sectors to the whim of unelected bureaucrats and political functionaries.<\/p>\n<p>Am I being bombastic? You tell me: given that the legislation that grants them the power to order a telecommunications service provider\u00a0<strong>\u201cto do or stop doing\u00a0<\/strong><em><strong>anything<\/strong>\u201c.\u00a0<\/em><\/p>\n<blockquote>\n<p><em>\u201cPart 1 amends the Telecommunications Act to add the promotion of the security of the Canadian telecommunications system as an objective of the Canadian telecommunications policy and to\u00a0<strong>authorize the Governor in Council and the Minister of Industry to direct telecommunications service providers to do anything, or refrain from doing anything, that is necessary to secure the Canadian telecommunications system.<\/strong>\u00a0It also establishes an administrative monetary penalty scheme to promote compliance with orders and regulations made by the Governor in Council and the Minister of Industry to secure the Canadian telecommunications system as well as rules for judicial review of those orders and regulations.\u201d<\/em><\/p>\n<\/blockquote>\n<p>I guess it all comes down to what you mean by \u201canything\u201d.<\/p>\n<p>Speaking of anything, the government can deem \u201cany\u201d service or system a vital service or system \u2013 which then makes that entity subject to requirements, that\u2026<\/p>\n<blockquote>\n<p><em>(a)\u2002authorizes the Governor in Council\u00a0<strong>to designate any service or system as a vital service or vital system<\/strong>;<\/em><\/p>\n<\/blockquote>\n<blockquote>\n<p><em>(b)\u2002authorizes the Governor in Council to\u00a0<strong>establish classes of operators<\/strong>\u00a0in respect of a vital service or vital system;<\/em><\/p>\n<p><em>(c)\u2002<strong>requires designated operators to, among other things<\/strong>, establish and implement cyber security programs, mitigate supply-chain and third-party risks, report cyber security incidents\u00a0<strong>and comply with cyber security directions<\/strong>;<\/em><\/p>\n<p><em>(d)\u2002provides for the exchange of information between relevant parties; and<\/em><\/p>\n<\/blockquote>\n<blockquote>\n<p><em>(e)\u2002authorizes the enforcement of the obligations under the Act and imposes consequences for non-compliance.<\/em><\/p>\n<\/blockquote>\n<p>Each one of these bullet points opens a can of worms unto itself, \u00a0combined they have the potential to effectively nationalize Canada\u2019s information infrastructure.<\/p>\n<p>The penalties for non-compliance are onerous: $1 million\u00a0<em>per day\u00a0<\/em>for individuals and $15 million \/day for any other entity.<\/p>\n<p><strong>But wait, there\u2019s more:<\/strong><\/p>\n<p>Under C-26, orders are filed in secret, telecommunications service providers (TSPs) can be ordered to cut off any user (including another TSP) while being barred from even informing the entity that it\u2019s happening, let alone why.<\/p>\n<p>The contents of said orders are secret and not even divulged to the target.\u00a0I recommend listening to the Michael Geist \/ Brenda McPhail podcast above to understand the threat to Canadians\u2019\u00a0<em>privacy<\/em>.<\/p>\n<p>Me, sitting here with my easyDNS hat on, running an internet service provider, I\u2019m dialled in on the\u00a0<em>due process<\/em>\u00a0aspects.<\/p>\n<p>More accurately, the complete\u00a0<em>absence\u00a0<\/em>of due process. We\u2019ve got twenty-five years experience of being told by various governments and their agencies to forgo due process and do things that would otherwise disrupt businesses, individual rights and even the network itself if we listened to them.<\/p>\n<p>Being told to\u00a0<em>do<\/em>\u00a0or\u00a0<em>stop doing<\/em>\u00a0\u201c<em>anything<\/em>\u201d seems overly broad.<\/p>\n<p><strong>It gets worse:<\/strong><\/p>\n<p>Similar to previous legislation, there are provisions for warrantless entry into places of business, or private homes, to search, copy or remove anything they deem relevant \u2013 including documents or telecommunications equipment.<\/p>\n<p>C-26 also permits the government to share data with\u00a0<em>foreign entities<\/em>. Again, this is all done without any of the privacy safeguards most citizens\u00a0<em>think<\/em>\u00a0they have as a constitutional right, because this bill, and this government, mostly ignores that those rights exist.<\/p>\n<h2>Non-Hypothetical Example<\/h2>\n<p>Last year, around this time, the same government that is introducing this bill arbitrarily enacted bank account seizures, not only against protestors, but also targeting\u00a0<a target=\"_blank\" href=\"https:\/\/cointelegraph.com\/news\/canada-invokes-emergencies-act-targeting-crowdfunding-and-crypto\" rel=\"noopener\">crowdfunded contributions<\/a>\u00a0to their fundraisers.<\/p>\n<p>This was done under the aegis of the Emergencies Act, however the seizures started before the EA was even ratified in Parliament, and the list of fundraising contributors was largely sourced from a third-party spreadsheet that was hacked from a foreign crowdfunding platform.<\/p>\n<p>Nevermind that the entire thing went away within a week \u2013 rationalized as \u201cmission accomplished\u201d (the reality was the measure\u00a0<a target=\"_blank\" href=\"https:\/\/www.zerohedge.com\/political\/bank-run-canadas-top-banks-mysteriously-go-offline\" rel=\"noopener\">sparked a run on banks<\/a>\u00a0and nearly blew up the Canadian financial system),<\/p>\n<p><a target=\"_blank\" data-image-external-href=\"\" data-image-href=\"\/s3\/files\/inline-images\/finbold-clip.png?itok=akkzdSD-\" data-link-option=\"0\" href=\"https:\/\/cms.zerohedge.com\/s3\/files\/inline-images\/finbold-clip.png?itok=akkzdSD-\" rel=\"noopener\"><\/a><\/p>\n<p><em>Not much mention of this in the MSM, oddly\u2026<\/em><\/p>\n<p>The 2022 invocation of the Emergencies Act\u00a0 made it clear that our government is perfectly willing to act unilaterally, without due process, in contravention of basic human rights to unbank people at whim.<\/p>\n<p>Bill C-26 will give them a veneer of Soviet-era legislation to unperson you in the online realm.<\/p>\n<h2>What Can You Do?<\/h2>\n<p>While I said I\u2019m not speaking with my ISCC hat on today, the Internet Society Canada Chapter is one of the civil society bodies that does its level best to bring informed, rational commentary and input to the policy making process. Membership includes a couple ex-CRTC commissioners and even a recent appointee to the Order of Canada.<\/p>\n<p>Consider\u00a0<a target=\"_blank\" href=\"https:\/\/internetsociety.ca\/\" rel=\"noopener\">signing up as a member today<\/a>\u00a0and help us bring a clue to the process, or alternatively, get behind\u00a0<a target=\"_blank\" href=\"https:\/\/ccla.org\/\" rel=\"noopener\">the Canadian Civil Liberties Association.<\/a><\/p>\n<p>You can also make your views known to your MP. They don\u2019t care if they get your vote or not, so don\u2019t even bother telling them you won\u2019t vote for them.
