Jackson Women\u2019s Health Organization. He <strong>strongly suggested that it was someone who opposed the opinion and wanted to pressure the justices not to go forward<\/strong> with the overturning of\u00a0<em>Roe v. Wade<\/em>.<\/p>\n<\/p>\n<p>Alito told the newspaper\u00a0<em><strong>\u201cI personally have a pretty good idea who is responsible, but that\u2019s different from the level of proof that is needed to name somebody.\u201d<\/strong><\/em><\/p>\n<p>Alito\u2019s confidence runs counter to the\u00a0<a target=\"_blank\" href=\"https:\/\/www.scribd.com\/document\/620770501\/Supreme-Court-Report-on-Dobbs-Leak#fullscreen=1\" rel=\"noopener\">two-page statement<\/a>\u00a0of the court that the team led by Marshal of the Supreme Court Gail Curley \u201chas to date been unable to identify a person responsible by a preponderance of the evidence.\u201d That is a standard lower than \u201cbeyond a reasonable doubt.\u201d It is often used in civil cases, but the evidence was viewed as below that standard.<\/p>\n<p>He added\u00a0<em><strong> \u201cIt was a part of an effort to prevent the\u00a0Dobbs\u00a0draft\u2026from becoming the decision of the court. And that\u2019s how it was used for those six weeks by people on the outside\u2014as part of the campaign to try to intimidate the court.\u201d<\/strong><\/em><\/p>\n<p>The statement suggests that such information on the specific suspect was shared with the justices.<\/p>\n<p>If this was a clerk and the evidence is known to all of the justices, it would be interesting if the justice responsible for the appointment felt comfortable in recommending the young lawyer for later employment.<\/p>\n<p><strong>Alito\u2019s statement contradicts those in the media like NPR\u2019s Nina Totenberg who insisted that \u201cthe only [theory] that makes sense\u201d is that a conservative leaked the opinion.<\/strong><\/p>\n<blockquote>\n<p><em>\u201cThat\u2019s infuriating to me,\u201d Justice Alito says of the theory. <\/em><\/p>\n<p><strong><em>\u201cLook, this made us targets of assassination. Would I do that to myself? Would the five of us have done that to ourselves? It\u2019s quite implausible.\u201d<\/em><\/strong><\/p>\n<\/blockquote>\n<p>At the time,\u00a0<a target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2022\/05\/09\/the-only-one-that-makes-sense-nprs-totenberg-claims-the-leading-theory-is-that-the-leaker-is-a-conservative-clerk\/\" rel=\"noopener\">I criticized Totenberg\u2019s claim<\/a>\u00a0as entirely unsupported and illogical.<\/p>\n<p><strong>We know from the investigation that clerks (but not justices) were\u00a0<a target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2022\/05\/31\/supreme-court-reportedly-to-demand-cellphones-and-affidavits-from-clerks-in-leak-investigation\/\" rel=\"noopener\">asked to sign affidavits<\/a>\u00a0after their interviews and the marshals emphasized that \u201cIf investigators later determine any personnel lied to the investigators, those personnel would be subject to prosecution for a false statement.\u201d<\/strong><\/p>\n<p>In a weird way, it seems even more troubling that the likely culprit may have been identified, but has proceeded into practice as an attorney.<\/p>\n<p>As I have previously written, this was a\u00a0<a target=\"_blank\" href=\"https:\/\/jonathanturley.org\/2022\/05\/06\/the-license-to-leak-how-years-of-attacks-on-the-court-may-have-created-a-by-any-means-mentality-on-the-court\/\" rel=\"noopener\">crushing blow to the Court<\/a>\u00a0and its traditions of integrity and civility. You cannot be an attorney after violating these core principles of our profession. This is akin to being an atheist priest or an arsonist architect. It is simply incompatible with our core identity, including being \u201cofficers of the court.\u201d<\/p>\n<p><strong>Whoever is responsible for this leak violated the most fundamental rules of ethics in our profession. It was a betrayal of not just the Court and the bar, but the public in shattering the confidentiality of the judicial process.<\/strong><\/p>\n<p>What is even more troubling is that, if the culprit were to come forward, the individual would likely be lionized by many. Indeed, I would not be surprised if, after the statute of limitations has passed, there could come a time when this person may want to take \u201ccredit\u201d for this disgraceful act. However, that may not occur for some time since this person likely wants to continue to practice as a lawyer despite violating an oath, making false statements, and disrupting the highest court.<\/p>\n<p><strong>Yet, it did not change the result.
