Alabama Lawmakers Advance ‘What Is A Woman’ Bill Defining Male, Female Sex<\/span><\/p>\n

Alabama lawmakers advanced legislation on May 24 that seeks to define an individual\u2019s sex based on their\u00a0reproductive systems under state law.<\/strong><\/p>\n

HB405 (pdf<\/a>), known as the \u201cWhat is a Woman\u201d Act, was introduced by Republican state Rep. Susan DuBose.<\/p>\n

The House Health Committee voted along party lines to approve the bill, which now heads to the House floor for a vote.<\/p>\n

Under the legislation,\u00a0a \u201cfemale\u201d is defined as an individual whose biological reproductive system is designed to produce ova, and a \u201cmale\u201d is defined as an individual whose biological reproductive system is designed to fertilize the ova of a female.<\/p>\n

The legislation also defines \u201cwoman\u201d and \u201cgirl\u201d as human females, while the terms \u201cman\u201d and \u201cboy\u201d refer to human males.<\/strong><\/p>\n

Elsewhere, the term\u00a0\u201cmother\u201d is defined as a parent that is of the female sex under state law, while the term \u201cfather\u201d is defined as a parent that is of the male sex.<\/p>\n

\u201cWhen it comes to sex, \u2018equal\u2019 does not mean \u2018same\u2019 or \u2018identical,’\u201d the legislation states. \u201cWhen it comes to sex, \u2018separate\u2019 is not inherently unequal.\u201d<\/p>\n

The legislation includes an exception in the case of individuals who are born with a medically verifiable diagnosis of a \u201cdisorder or difference in sex development,\u201d and such individuals will be provided\u00a0legal protections and accommodations afforded under the federal Americans with Disabilities Act, according to the measure.<\/p>\n

Bill Protects Women, Lawmakers say<\/h2>\n

\u201cNotwithstanding any state law to the contrary, there are legitimate reasons to distinguish between the sexes with respect to athletics, prisons or other detention facilities, domestic violence shelters, rape crisis centers, locker rooms, bathrooms, and other areas where biology, safety, or privacy are implicated,\u201d the measure states.<\/p>\n

\u201cPolicies and laws that distinguish between the sexes are subject to intermediate constitutional scrutiny, which forbids unfair discrimination against similarly-situated males and females but allows the law to distinguish between the sexes where such distinctions are substantially related to important governmental objectives<\/strong>,\u201d it adds.<\/p>\n

The measure would also require any state department, school district, or public school to include an individual\u2019s biological sex in all reporting of\u00a0health, crime, economic, or other data.<\/p>\n

DuBose has argued that the bill is needed to prevent\u00a0violence from occurring in \u201cwomen\u2019s spaces,\u201d\u00a0telling AL.com<\/a> that such incidents are occurring in places \u201cthroughout our nation\u201d that are open to transgender women, who are biological males.<\/p>\n

The Republican lawmaker stressed that the bill \u201cis in no way trying to deny their existence, or their rights or their relevance or their importance,\u201d referring to transgender women, adding that she believes the legislation will \u201caffect a few women that are in these very specific situations,\u201d and not the majority of people.<\/p>\n
