Artificial Intelligence Meets Artificial Regulation<\/span><\/p>\n

There\u2019s an old military adage: \u201cnever volunteer for anything.\u201d\u00a0<\/strong> At first blush, it might seem downright unpatriotic.\u00a0 But perhaps this saying was coined by an officer who spent too much time in Washington.<\/p>\n

<\/a><\/p>\n

Last month, the Biden administration marshalled executives from Google, Amazon, Microsoft, Meta, OpenAI, Anthropic, and Inflection to the White House\u00a0to sign a \u201cvoluntary\u201d agreement<\/a>\u00a0that, among other things, would subject their AI systems to audits before public release and require data sharing with the government and academics.<\/p>\n

If the agreement were truly \u201cvoluntary,\u201d there would be no need for anyone to travel to D.C., much less the White House.\u00a0 Willing businesses could simply sign the pledge virtually, promising best efforts towards an ostensibly noble goal\u2014assuming that doing so wouldn\u2019t invite antitrust questions.<\/p>\n

But, of course, the agreement was anything but voluntary.<\/strong>\u00a0 It was planned and coordinated by the White House.\u00a0 America has hundreds of thousands of businesses that enter into contracts and agreements on daily basis.\u00a0 Few, if any, of them visit Washington\u2014much less the White House\u2014purely of their own volition.<\/p>\n

So then, why did major tech and AI executives find themselves in D.C. last month?\u00a0<\/p>\n

Simply put\u2014at the moment, there are no federal laws or regulations governing the use of AI.\u00a0 And the Administration\u00a0wishes that wasn\u2019t the case<\/a>.<\/p>\n

To attempt to remedy this, the administration negotiated the now-signed \u201cvoluntary\u201d agreement with America\u2019s leading AI firms.\u00a0 <\/strong>It\u2019s likely fair to assume that the White House may have made concessions to individual companies that signed the agreement, and in turn may have threatened actions if a company refused to sign.\u00a0 Indeed, just as unlucky military members \u201cdiscover\u201d reasons to volunteer for dangerous missions, there were undoubtedly reasons these companies signed the White House\u2019s \u201cvoluntary\u201d agreement.<\/p>\n

It gets worse<\/strong>.\u00a0 The signatories\u2019 not-so-voluntary volunteerism will continue far beyond the agreement\u2019s signing, if the federal government has its way.\u00a0 Astonishingly, the Washington Post reports that deviations from the agreements by its signatories\u00a0might be deemed deceptive practices that run afoul of Section 5 of the FTC Act<\/a>, according to a Commission official \u201cwho spoke on the condition of anonymity to discuss the agency\u2019s thinking on enforcement.\u201d<\/p>\n

Nevertheless,\u00a0the\u00a0Post<\/em>\u00a0notes<\/a>\u00a0that \u201cthe pledge does not include specific deadlines or reporting requirements\u2014and the mandates are outlined in broad language\u2014which could complicate regulators\u2019 efforts to hold the companies to their promises.\u201d\u00a0 Yet, during a speech about the pledge, President Biden claimed that \u201cthese commitments are real, and they are concrete.\u201d\u00a0 So which is it?\u00a0 <\/strong>How would enforcement work?\u00a0 Are only the seven businesses that signed the so-called \u201cvoluntary\u201d agreement liable for breaking it?\u00a0 Are firms that did not sign it liable too?<\/p>\n

None of this is how our government is supposed to work.\u00a0 Usually, government officials are required\u00a0publicly<\/em>\u00a0to explain how they will enforce\u00a0regulations<\/em>\u00a0either in court or through agency administrative processes.\u00a0 Alternatively, they would garner public support for legislation and get a bill signed into law\u00a0the increasingly old-fashioned way<\/a>.<\/p>\n

But there are no regulations for AI<\/strong>; nor are there clear and accepted guidelines to distinguish fair and unfair trade practices for AI.\u00a0 An\u00a0anonymous\u00a0<\/em>government official might lob\u00a0threats\u00a0<\/em>as to how an agency might punish deviations from a \u201cvoluntary\u201d agreement, but any FTC efforts to do so would have to go to court\u00a0in<\/em>\u00a0public<\/em>, where a skeptical judge might wonder how a \u201cvoluntary\u201d agreement to which the FTC is not a party could be enforced by it.<\/p>\n

Indeed, asking a federal agency to enforce a voluntary agreement to which it is not a party makes little sense, particularly when the agency has no statutory authority to regulate the content of the agreement.\u00a0\u00a0 To the extent AI requires regulation, the better approach would be for Congress to pass a law carefully instructing an agency such as the FTC on how to regulate AI.\u00a0 That hasn\u2019t happened.<\/p>\n

Inviting top business leaders to the White House to sign a \u201cvoluntary\u201d agreement that a federal agency secretly seeks to enforce\u2014despite no statutory authority to regulate the substance of the agreement\u2014is no way to run a government.\u00a0<\/p>\n

Ultimately, the White House\u2019s AI moves should be considered \u201cartificial regulation.\u201d\u00a0 While the threats are real, the regulation is anything but.<\/p>\n
