{"id":1427337,"date":"2023-09-13T21:40:00","date_gmt":"2023-09-14T01:40:00","guid":{"rendered":"https:\/\/bugaluu.com\/news\/?p=1427337"},"modified":"2023-09-13T21:40:00","modified_gmt":"2023-09-14T01:40:00","slug":"not-so-fast-karen-federal-judge-blocks-new-mexico-governors-health-emergency-to-suspend-gun-rights","status":"publish","type":"post","link":"https:\/\/bugaluu.com\/news\/not-so-fast-karen-federal-judge-blocks-new-mexico-governors-health-emergency-to-suspend-gun-rights\/1427337\/","title":{"rendered":"Not So Fast Karen: Federal Judge Blocks New Mexico Governor&#8217;s &#8220;Health Emergency&#8221; To Suspend Gun Rights"},"content":{"rendered":"<p><span class=\"field field--name-title field--type-string field--label-hidden\">Not So Fast Karen: Federal Judge Blocks New Mexico Governor&#8217;s &#8220;Health Emergency&#8221; To Suspend Gun Rights<\/span><\/p>\n<div class=\"clearfix text-formatted field field--name-body field--type-text-with-summary field--label-hidden field__item\">\n<p>Has the trial balloon just popped?<\/p>\n<p>A federal judge in Albuquerque has <strong>blocked part of New Mexico Governor Michelle Lujan Grisham&#8217;s &#8216;public health emergency&#8217; <\/strong><a href=\"https:\/\/www.zerohedge.com\/political\/full-authoritarian-new-mexico-governor-restricts-constitutional-gun-rights-law-abiding\">to disarm law abiding citizens<\/a> who wish to carry firearms either open or concealed in public.<\/p>\n<p><a href=\"https:\/\/cms.zerohedge.com\/s3\/files\/inline-images\/GettyImages-1145807518-Grisham-_jpg1.jpg?itok=yK7YPbYN\"><\/a><\/p>\n<p>The ruling comes after both the state AG and various other officials said they&#8217;d refuse to enforce it, <em>AP<\/em> reports.<\/p>\n<p><em>The ruling Wednesday by U.S. District Judge David Urias <strong>marks a setback for Democratic New Mexico Gov. Michelle Lujan Grisham <\/strong>as she responds to several recent shootings that took the lives of children, including an 11-year-old boy as he left a minor league baseball game in Albuquerque. &#8211;<a href=\"https:\/\/www.wfla.com\/news\/national\/ap-us-news\/ap-u-s-district-considers-requests-against-new-mexico-governor-order-suspending-right-to-carry\/\">AP<\/a><\/em><\/p>\n<p>The order has been slammed on both sides of the aisle, as even gun-grabbing Democrats like Ted Lieu called it unconstitutional, and far-left rag <em>Slate<\/em> says it&#8217;s &#8220;<a href=\"https:\/\/slate.com\/news-and-politics\/2023\/09\/democrat-lujan-grisham-new-mexico-gun-ban.html\">already backfiring<\/a>.&#8221;<\/p>\n<p>Lawsuits have been filed, calls for impeachment have been sounded, <strong>and now, famed 2nd Amendment author and economist John R. Lott Jr. has chimed in <\/strong><strong>with a dose of sanity<\/strong>.<\/p>\n<p>As he writes in <a href=\"https:\/\/realclearwire.com\/articles\/2023\/09\/13\/new_mexico_governor_flouts_2nd_amendment.html\"><em>RealClear Wire<\/em><\/a>:<\/p>\n<p>After several road rage cases claimed the lives of children this summer, New Mexico Gov. Michelle Lujan Grisham\u00a0<a href=\"https:\/\/www.governor.state.nm.us\/wp-content\/uploads\/2023\/09\/Executive-Order-2023-130.pdf\">suspended<\/a>\u00a0the open and concealed carry of firearms in Albuquerque and throughout Bernalillo County for the next 30 days. Grisham\u2019s response will not make New Mexicans safer. Indeed, the opposite is true.<\/p>\n<p><strong>\u00a0None of the attacks that Grisham can point to involved permit holders<\/strong>. That\u2019s not too surprising \u2013 permit holders in New Mexico and the rest of the country are exceptionally law-abiding.\u00a0In 2021, there was just <a href=\"https:\/\/crimeresearch.org\/2022\/11\/concealed-carry-permit-holders-across-the-united-states-2021-2\/\">one revocation for every 45,000 permit holders<\/a>\u00a0in New Mexico. Nor was that an outlier. In <a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=3703977\">2019<\/a> and <a href=\"http:\/\/ssrn.com\/abstract=3937627\">2020<\/a>, there were no revocations.<\/p>\n<p>\u00a0For criminals, it is already illegal to carry guns.<strong> All Grisham\u2019s edict does is make it illegal for law-abiding citizens to carry.\u00a0<\/strong><\/p>\n<p>\u00a0<a href=\"https:\/\/www.amazon.com\/More-Guns-Less-Crime-Understanding\/dp\/1707911975\/ref=sr_1_1?crid=2PYQ4HPEPWQN0&amp;keywords=more+guns+less+crime&amp;qid=1636267088&amp;sprefix=More+Guns+L,aps,238&amp;sr=8-1\">Academic research<\/a> shows that police are the most important factor in reducing crime. However, the police understand that they virtually always arrive at the crime scene after the crime occurs, as one recent road rage incident illustrates. At the end of August, a law-abiding citizen with a permit <a href=\"https:\/\/www.krqe.com\/news\/crime\/more-details-in-road-rage-shooting-on-i-25-near-isleta-pueblo\/\">used his gun to protect<\/a>\u00a0himself from a road rage attack near Isleta Pueblo, New Mexico.<\/p>\n<p>\u00a0The Albuquerque police department\u00a0<a href=\"https:\/\/www.koat.com\/article\/abq-does-not-have-enough-police-officers\/38027583\">doesn\u2019t<\/a>\u00a0have enough officers to answer every call for help. Police Chief Harold Medina\u00a0<a href=\"https:\/\/www.koat.com\/article\/abq-does-not-have-enough-police-officers\/38027583\">acknowledges<\/a>\u00a0that Albuquerque ranks at the bottom of cities in police officers per capita. And by the\u00a0<a href=\"https:\/\/www.krqe.com\/plus\/data-reporting\/what-is-being-done-with-albuquerques-police-officer-shortage\/\">end of 2021<\/a>, Albuquerque had only 70% of the number of police officers\u00a0<a href=\"https:\/\/www.koat.com\/article\/abq-does-not-have-enough-police-officers\/38027583\">that it should have<\/a>. When the police cannot protect people, the solution is not to disarm law-abiding citizens.\u00a0<\/p>\n<p>\u00a0<a href=\"https:\/\/www.krqe.com\/digital-now\/albuquerque-police-release-2022-crime-stats\/#:~:text=Violent%2520Crime,-In%2520addressing%2520violent&amp;text=APD%2520says%2520120%2520homicides%2520occurred,2022%252C%2520according%2520to%2520APD%2527s%2520statistics.\">Albuquerque\u2019s murder rate has soared by 70% while Grisham has been governor<\/a>. But<strong> instead of addressing the problems created by Democrats\u2019 attitudes toward law enforcement, Grisham blames the crime surge on law-abiding gun owners.<\/strong><\/p>\n<p>\u00a0There are now over\u00a0<a href=\"https:\/\/crimeresearch.org\/2022\/11\/concealed-carry-permit-holders-across-the-united-states-2021-2\/\">22 million concealed handgun permit holders<\/a>\u00a0nationwide, and we have decades of data on the behavior of permit holders. Some other states have especially detailed data. In Florida and Texas, permit holders are convicted of firearms-related violations\u00a0<a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=3937627\">at one-twelfth the rate at which police officers<\/a> are. And police are convicted at just one-twentieth of the rate for the general population at large.<\/p>\n<p><strong>The average concealed carry permit revocation rate in the 19 states with comprehensive data is one-tenth of one percent.<\/strong> Usually, revocations occur because someone moves, dies, or forgets to bring the permit while carrying.<\/p>\n<p>\u00a0<a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=3896829\">Academics have published 52 peer-reviewed empirical studies<\/a>\u00a0on concealed carry. Of these, 25 found that allowing people to carry reduces violent crime, and 15 found no significant effect. A minority (12) observed increases in violent crime. These 12, however, suffer from systematic errors to varying degrees: They tend to focus on the last 20 years and compare states that recently passed concealed carry laws with earlier states that already had those laws. The latter states, where it was more difficult to obtain a permit, had smaller, sustained growth in permits over the past two decades. The finding that crime rose relatively in the recently adopting states <a href=\"http:\/\/ssrn.com\/abstract=3850436\">is consistent<\/a> with the states having the biggest increase in permit holders having the greatest reduction in crime.<\/p>\n<p>\u00a0While the Supreme Court would likely strike down Grisham\u2019s 30-day executive order, the governor may have calculated that the suspension period was too short for the courts to successfully intervene. Assuming that Grisham doesn\u2019t get a sympathetic trial judge, there might still be time to get a preliminary injunction. But the case would be moot by the time it would get to the circuit court, let alone the Supreme Court.<\/p>\n<p>\u00a0Police are essential to keeping the peace and bringing criminals to justice, but in most cases, they can\u2019t directly protect people.<strong> That\u2019s why Gov. Grisham owes the residents of her state the chance to protect themselves.<\/strong><\/p>\n<p>*\u00a0 *\u00a0 *<\/p>\n<p>And as the<em> <a href=\"https:\/\/mises.org\/wire\/no-governor-rights-are-not-government-issued-privileges-you-can-suspend\">Mises Institute<\/a>&#8216;<\/em>s Connor O&#8217;Keeffe reminds Grisham, <strong>constitutional rights aren&#8217;t government-issued privileges that you can simply suspend<\/strong>;<\/p>\n<p>Grisham is distorting how rights work to justify her program. She frames rights as a handful of unrelated positive freedoms granted to citizens by the government, which can revoke them during emergencies or when they conflict with rights that government officials deem more important.<\/p>\n<p><strong>In reality, rights are derived from self-ownership<\/strong>. We alone have the highest claim to our own bodies. That right is absolute, so any aggression against our bodies is a rights violation that can be justly resisted or punished proportionately.<\/p>\n<p>And from self-ownership, we can derive the just ownership of property. Self-ownership gives you the highest claim to the fruits of your labor. Unowned resources can justly become owned through <a href=\"https:\/\/mises.org\/library\/crusoe-social-philosophy\">homesteading<\/a>\u2014mixing your labor with unowned natural resources. Once these resources are owned, they can be justly transferred as gifts or through voluntary exchange. Because they are derived from self-ownership, property rights are absolute, meaning any violation can be justly resisted or punished proportionately.<\/p>\n<p><strong>We can see, then, that the right not to be harmed and the right to own property do not conflict\u2014they are variations of the same fundamental right.<\/strong> This is especially evident when the property in question equips us to better protect ourselves and our other property. That\u2019s the case with firearms. The debate Grisham calls for is built on a lie.<\/p>\n<p>The governor is trying to account for the government\u2019s failures to protect people, a service it monopolizes, by violating the property rights of Bernalillo County citizens. She understands this is probably illegal and at the press conference even called herself courageous for moving ahead anyway. Even though, unlike the rest of us outside of government, she wouldn\u2019t face consequences if it were determined that what she\u2019s doing is illegal. She\u2019d, at most, be told to stop.<\/p>\n<p>Or so she thought. Instead, over the weekend, the gun owners of Bernalillo County <a href=\"https:\/\/www.youtube.com\/watch?v=rhfTLZwGdB8\" target=\"_blank\" rel=\"noopener\">took to the streets<\/a>, carrying their weapons peacefully in protest. And the Albuquerque police chief and Bernalillo County sheriff <a href=\"https:\/\/abcnews.go.com\/US\/new-mexico-governors-temporary-ban-carrying-guns-public\/story?id=103067888\" target=\"_blank\" rel=\"noopener\">issued statements<\/a> saying they would not enforce the governor\u2019s order.
