Gavin Newsom&#8217;s draconian &#8216;Covid-19 medical misinformation&#8217; law, which would threaten the licenses of doctors who don&#8217;t agree with &#8220;scientific consensus&#8221; on various issues.<\/p>\n<p><a href=\"https:\/\/cms.zerohedge.com\/s3\/files\/inline-images\/ivermectin%20tablets%206mg1_2.jpg?itok=r4zpcy0L\"><\/a><\/p>\n<p>The law, AB 2098, was signed into law by Newsom last year. In response, <strong>five doctors alleged it to be unconstitutional <\/strong>under the First and Fourteenth Amendments of the US constitution.<\/p>\n<p>The five doctors, Tracy Hoeg, Ram Duriseti, Aaron Kheriaty, Pete Mazolewski, and Azadeh Khatibi, argued that the law prevents them\u00a0from providing information to their patients that may contradict what the law permits or prohibits.\u00a0They also alleged the law was\u00a0used to intimidate and punish physicians who disagreed with prevailing views on COVID-19.<\/p>\n<\/p>\n<p><strong>Now, as the lawsuit heats up, California has quietly added a provision to repeal the law<\/strong> to Senate Bill 815, which makes changes to the California Medical Board, <a href=\"https:\/\/justthenews.com\/government\/state-houses\/california-quietly-disavows-medical-misinformation-law-courts-can-strike-it\"><em>Just the News<\/em><\/a> reports.<\/p>\n<p><em>Jenin Younes and Laura Powell, lawyers for one set of doctors who <a href=\"https:\/\/justthenews.com\/government\/courts-law\/judge-halts-california-covid-misinformation-law-targeting-doctors\">obtained a preliminary injunction<\/a> against the law in January, told Just the News they were blindsided by the repeal provision, saying it wasn&#8217;t part of any settlement talks in their case.<\/em><\/p>\n<p><em>&#8220;It&#8217;s incredibly last minute,&#8221; Powell said. &#8220;Thursday is the last day to vote on bills, and it has to be passed by both chambers. T<strong>he Medical Board itself didn&#8217;t mention any such provision at its <a href=\"https:\/\/www.youtube.com\/watch?v=becbu4sc_tU&amp;t=14440s\">Aug. 24 meeting<\/a> or in the <a href=\"https:\/\/www.mbc.ca.gov\/About\/Meetings\/Material\/31188\/brd-AgendaItem9a-20230824.pdf\">agenda<\/a>.<\/strong><\/em><\/p>\n<p><em>The repeal provision then appeared in the <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202320240SB815\">Sept. 5 version<\/a> of the bill and remains in the <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202320240SB815\">latest version, Sept. 11<\/a>. It&#8217;s also mentioned in two Assembly floor analyses last week, without elaboration. The last three bill versions were amended by the Assembly, and the first three, the Senate.<\/em><\/p>\n<p><em>Just the News could not get an explanation from SB 815&#8217;s Senate sponsor or Assembly principal coauthor how, when and why the repeal provision got in the bill.<\/em><\/p>\n<p>A huge embarrassment for Newsom and the Supermajority.<\/p>\n<p>Their COVID medical censorship law has been so thoroughly condemned across the political spectrum and so roundly rejected by courts that the Legislature is repealing its own law a year after passage. <a href=\"https:\/\/t.co\/7ZChvUSfIv\">pic.twitter.com\/7ZChvUSfIv<\/a><\/p>\n<p>\u2014 Kevin Kiley (@KevinKileyCA) <a href=\"https:\/\/twitter.com\/KevinKileyCA\/status\/1701353977437360624?ref_src=twsrc%5Etfw\">September 11, 2023<\/a><\/p>\n<p><strong>Judge slaps CA lawyer around<\/strong><\/p>\n<p>Younes, the lawyer in the Hoeg case, told <em>JTN<\/em> that it&#8217;s not clear whether the repeal provision is related to a 9th US Circuit Court of Appeals hearing in a different lawsuit that went &#8216;very badly for the state.&#8217; Five days before that hearing, <strong>the provision to drop the law wasn&#8217;t in a July 12 version of the bill<\/strong>.\u00a0<\/p>\n<p>In that hearing, <strong>Judge Danielle Forrest did not go easy on Deputy AG Kristin Liska<\/strong>, who claimed that doctors could tell patients that &#8220;garlic cures cancer&#8221; if the court strikes the law down.<\/p>\n<p>&#8220;<strong>You give some dramatic examples, and I understand why<\/strong>,&#8221; said Forrest.
