{"id":1447349,"date":"2024-01-02T20:25:00","date_gmt":"2024-01-03T01:25:00","guid":{"rendered":"https:\/\/bugaluu.com\/news\/?p=1447349"},"modified":"2024-01-02T20:25:00","modified_gmt":"2024-01-03T01:25:00","slug":"destroying-democracy-to-save-it-maine-shows-the-danger-of-zealots-in-our-legal-system","status":"publish","type":"post","link":"https:\/\/bugaluu.com\/news\/destroying-democracy-to-save-it-maine-shows-the-danger-of-zealots-in-our-legal-system\/1447349\/","title":{"rendered":"Destroying Democracy To Save It: Maine Shows The Danger Of Zealots In Our Legal System"},"content":{"rendered":"<p><span class=\"field field--name-title field--type-string field--label-hidden\">Destroying Democracy To Save It: Maine Shows The Danger Of Zealots In Our Legal System<\/span><\/p>\n<div class=\"clearfix text-formatted field field--name-body field--type-text-with-summary field--label-hidden field__item\">\n<p><a href=\"https:\/\/jonathanturley.org\/2024\/01\/02\/destroying-democracy-to-save-it-maine-shows-the-danger-of-zealots-in-our-legal-system\/\"><em>Authored by Jonathan Turley,<\/em><\/a><\/p>\n<p>Below is my column in the Hill on the Maine decision and how it is <strong>illustrative of Justice Louis Brandeis\u2019 warning of the danger of zealots.<\/strong> Shenna Bellows has long embraced extreme political and historical viewpoints, including <strong>denouncing the electoral college as a \u201c<a href=\"https:\/\/nypost.com\/2023\/12\/30\/news\/maine-dem-who-kicked-trump-off-ballot-called-electoral-college-white-supremacy\/\">relic of white supremacy<\/a>.\u201d\u00a0<\/strong> Challengers knew that they \u201chad her at hello\u201d in seeking to disqualify former president Donald Trump.<\/p>\n<p><strong>The coming week will likely show how the Supreme Court will address the issue.<\/strong><\/p>\n<p>Here is the column:<\/p>\n<p><em><strong><a href=\"https:\/\/www.youtube.com\/watch?v=AyrP-pwDayE\">\u201cYou had me at hello.\u201d<\/a>\u00a0<\/strong><\/em>That line from the movie \u201cJerry Maguire\u201d came to mind this week after yet another Democratic secretary of state moved to prevent citizens from voting for former president Donald Trump.<\/p>\n<p>Maine\u2019s\u00a0<a href=\"https:\/\/thehill.com\/people\/shenna-bellows\/\">Shenna Bellows\u00a0<\/a>issued a \u201cdecision\u201d that declared Trump an \u201cinsurrectionist\u201d and ineligible to be president.<strong> She joined an ignoble list of Democratic officials in states such as Colorado who claim to safeguard democracy by denying its exercise to millions of Americans.<\/strong><\/p>\n<p><a href=\"https:\/\/cms.zerohedge.com\/s3\/files\/inline-images\/2024-01-02_09-19-44.jpg?itok=1EQYJeMf\"><\/a><\/p>\n<p>Yet the most striking aspect of this poorly crafted decision was not its litany of conclusory findings, but rather <strong>Bellow\u2019s implausible suggestion that she struggled over the decision.<\/strong> Bellows was a natural choice for challengers, who have been searching for any officials or courts willing to embrace this dangerous theory under the Fourteenth Amendment that they can unilaterally bar candidates deemed rebellious or insurrectionist.<\/p>\n<p>Challengers knew that they had Bellows at hello. She was one of the first officials to declare the Jan. 6 riot to be an \u201cinsurrection\u201d prompted by Trump\u2019s speech.<\/p>\n<p><strong>Bellows previously\u00a0<a href=\"https:\/\/thehill.com\/homenews\/campaign\/4379246-trump-demands-recusal-maine-secretary-of-state-14th-amendment-determination\/\">declared<\/a>\u00a0that \u201cthe Jan. 6 insurrection was an unlawful attempt to overthrow the results of a free and fair election\u2026The insurrectionists failed, and democracy prevailed.\u201d\u00a0<\/strong><a href=\"https:\/\/twitter.com\/shennabellows\/status\/1479269064539267072\">A year after the riot<\/a>, Bellows was still denouncing the \u201cviolent insurrection.\u201d<\/p>\n<p>Of course, in the 1996 movie, Jerry Maguire reminded Dorothy that \u201d we live in a cynical world \u2014 a cynical, cynical world \u2014 and we work in a business of tough competitors.\u201d However,\u00a0 he added \u201cyou complete me.\u201d<\/p>\n<p><strong>In our cynical politics, Bellows and\u00a0Colorado Secretary of State Jena Griswold, among others, have become wildly popular for seeking to complete the effort to defeat Trump by removing him from the ballot. <\/strong><\/p>\n<p>This cynicism is captured in statements from pundits who warn that Democrats can no longer rely on the election process, given Trump\u2019s soaring popularity.<\/p>\n<p>One columnist\u00a0<a href=\"https:\/\/www.penncapital-star.com\/commentary\/if-the-gop-wont-do-it-democrats-will-have-to-block-trumps-nomination-for-them-bruce-ledewitz\/\">wrote<\/a>\u00a0that <em><strong>\u201cDemocrats may have to act radically to deny Donald Trump the 2024 Republican nomination. We cannot rely on Republicans to do it\u2026Trump must be defeated. No matter what it takes.\u201d<\/strong><\/em><\/p>\n<p>Many Democratic jurists and officials have refused to participate in this cynical effort to win the election through the courts. Maine\u2019s Democratic U.S. Rep. Jared Golden\u00a0<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4380963-maine-democrat-says-trump-should-be-on-ballot-we-are-a-nation-of-laws\/\">denounced Bellows decision<\/a>. California Governor\u00a0<a href=\"https:\/\/thehill.com\/people\/gavin-newsom\/\">Gavin Newsom\u00a0<\/a>(D)\u00a0<a href=\"https:\/\/www.politico.com\/news\/2023\/12\/22\/newsom-pans-efforts-to-block-trump-from-california-ballot-00133152\">warned Democrats against embracing this legal theory<\/a>. His state\u2019s secretary of state Shirley Weber (D) had\u00a0<a href=\"https:\/\/www.dailymail.co.uk\/news\/article-12909859\/california-democratic-secretary-state-refuses-remove-trump-ballot.html\">refused to do what Bellows just did<\/a>.<\/p>\n<p><strong>Yet Democrats know that they need only to remove Trump from the ballots of a couple of key states to make him constitutionally incapable of becoming president, due to the electoral college. Thus, Trump could be the overwhelming choice of the voters but still be effectively barred from assuming office.<\/strong><\/p>\n<p>To achieve this end, advocates are willing to adopt the type of ballot-cleansing powers long associated with authoritarian countries such as Iran. That is why this theory of disqualification remains one of the most dangerous to arise in our nation\u2019s history.<\/p>\n<p>The U.S. stands as the most successful and stable democratic system in history. In the blind quest to block Trump \u201cat any cost,\u201d these officials have introduced a destabilizing element to our system that could be replicated in tit-for-tat politics for years to come. It has\u00a0<a href=\"https:\/\/thehill.com\/homenews\/campaign\/4369472-texas-dan-patrick-biden-ballot-border\/\">already begun<\/a>,\u00a0with Republicans calling to bar President Joe Biden from ballots.<\/p>\n<p><strong>The ballot-cleansing effort is only the latest example of what Justice Louis Brandeis identified as the true threat to our democracy \u2014 not the threat from other countries, but from within.<\/strong><\/p>\n<p><em>\u201cThe greatest dangers to liberty lurk in insidious encroachment by men of zeal, well meaning but without understanding,\u201d<\/em> he said.<\/p>\n<p><strong>Some of these advocates exhibit precisely that zealotry of someone who seems to understand little beyond the next election, as opposed to the next generation.<\/strong><\/p>\n<p>The Supreme Court should act not only with finality but with unanimity in rejecting this pernicious disqualification theory. But these same advocates are likely to seek to delay or avoid such review. Even on the Colorado Supreme Court composed entirely of Democratically appointed justices, advocates could only eke out a 4-3 ruling, with a vehement dissent rejecting this theory.<\/p>\n<p>There is a real chance that one or more of the liberal justices will show the same fealty to the constitution in rejecting the theory. That would undermine the claims of figures like Joe Scarborough that arguments against barring Trump are \u201claughable\u201d and should be \u201cmocked.\u201d While the MSNBC host\u00a0<a href=\"https:\/\/archive.org\/details\/MSNBCW_20231221_110000_Morning_Joe\/start\/4006\/end\/4066?q=donald+trump\">demanded that his interlocutors<\/a>\u00a0\u201cspare me the anti-democratic lectures,\u201d advocates are likely worried about getting precisely such a lecture, and a scathing one, from the Supreme Court.<\/p>\n<p><strong>Accordingly, if the court does not rule on the Colorado decision, Colorado may seek to moot the appeal, since the ballot would remain unchanged with Trump\u2019s name on it.<\/strong><\/p>\n<p>Some justices may prefer this cup to pass from their lips. The divisive opinion in Bush v. Gore from 2000 still reverberates to this day.<\/p>\n<p><strong>For an intense institutionalist like Chief Justice John Roberts, there is a tendency to take exit ramps to avoid rulings if these conflicts can be resolved in the lower courts.<\/strong><\/p>\n<p>However, the court now\u00a0<a href=\"https:\/\/jonathanturley.org\/2023\/12\/21\/the-call-of-history-it-is-time-for-the-court-to-speak-as-one-in-overturning-the-colorado-opinion\/\">faces a call of history<\/a>. After the Maine decision, the justices must realize that neither they nor the country can avoid this moment. Indeed, the court was designed for this moment: to stand between rage and reason; between cynicism and constitutionalism.<\/p>\n<p>Proponents knew exactly whom to call upon for the right answer. <strong>Yet, to their credit, other Democrats, from California to Maine, did not say \u201chello\u201d but \u201chell no\u201d to this proposal.
