{"id":1449929,"date":"2024-01-10T18:25:00","date_gmt":"2024-01-10T23:25:00","guid":{"rendered":"https:\/\/bugaluu.com\/news\/?p=1449929"},"modified":"2024-01-10T18:25:00","modified_gmt":"2024-01-10T23:25:00","slug":"appeals-court-strikes-down-biden-admins-washing-machine-regulations","status":"publish","type":"post","link":"https:\/\/bugaluu.com\/news\/appeals-court-strikes-down-biden-admins-washing-machine-regulations\/1449929\/","title":{"rendered":"Appeals Court Strikes Down Biden Admin&#8217;s Washing Machine Regulations"},"content":{"rendered":"<p><span class=\"field field--name-title field--type-string field--label-hidden\">Appeals Court Strikes Down Biden Admin&#8217;s Washing Machine Regulations<\/span><\/p>\n<div class=\"clearfix text-formatted field field--name-body field--type-text-with-summary field--label-hidden field__item\">\n<p><a href=\"https:\/\/www.theepochtimes.com\/us\/appeals-court-strikes-down-biden-admins-washing-machine-regulations-5562027?utm_source=partner&amp;utm_campaign=ZeroHedge\"><em>Authored by Aldgra Fredly via The Epoch Times,<\/em><\/a><\/p>\n<p>The 5th U.S. Circuit Court of Appeals earlier in the week blocked the Biden administration\u2019s efforts to repeal Trump-era efficiency standards regulating water usage in dishwashers and laundry machines.<\/p>\n<p><a href=\"https:\/\/cms.zerohedge.com\/s3\/files\/inline-images\/energystar.jpg?itok=rXUlouVO\"><\/a><\/p>\n<p>In its <a href=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2024\/01\/10\/id5562285-Dishwashers-CA5-Opinion.pdf\">ruling on Jan. 8<\/a>, <strong>the court said the Department of Energy\u2019s (DOE) actions to tighten the regulatory regime in 2022 were \u201carbitrary and capricious.\u201d<\/strong><\/p>\n<p><em>\u201cEven if DOE could consider dishwashers\u2019 and clothes washers\u2019 \u2018efficiency\u2019 in both \u2018energy use\u2019 and \u2018water use,\u2019 the 2020 Rules likely promoted greater efficiency in both categories than the Repeal Rule.<\/em><\/p>\n<p><em>\u201cAssuming both energy conservation metrics are on the table, the States argue, and DOE does not appear to dispute, that one important aspect of that problem is whether appliance regulations actually reduce energy and water consumption,\u201d it added.<\/em><\/p>\n<p>In 2020, the DOE released two final rules that established product classes for residential dishwashers with a normal cycle time of 60 minutes or less, top-loading washing machines with a normal cycle time 30 minutes or less, and front-loading machines with a normal cycle time of 45 minutes or less.<\/p>\n<p>The Biden administration in 2022 finalized a rule to revoke the two earlier rules, which it said contain \u201cimproperly promulgated standards,\u201d reinstating the prior product classes and applicable standards.<\/p>\n<p><strong>A group of states led by Louisiana petitioned for review of the DOE\u2019s repeal. The court said it granted the petition and remanded the rules back to the department.<\/strong><\/p>\n<p>The court also questioned whether the DOE has \u201cstatutory authority\u201d to regulate water use in dishwashers and clothes washers.<\/p>\n<p><em>\u201dBut even if DOE has water-usage authority over the relevant appliances, the Department failed to adequately consider the negative consequences of the Repeal Rule, including the substitution effects of energy-and-water-wasting rewashing, prewashing, and handwashing.<\/em><\/p>\n<p><em>\u201cAnd in all events, the 2022 DOE failed to adequately consider the impact of the energy conservation program on \u2018performance characteristics,\u2019\u201d it added.<\/em><\/p>\n<p>Louisiana Attorney General Liz Murrill said the court\u2019s decision marks a \u201cbig win\u201d for families in the United States.<\/p>\n<p><em><strong>\u201cIt\u2019s not \u2018energy efficient\u2019 to have to wash your dishes and clothes twice (for hours),\u201d <\/strong>Ms. Murrill stated on social media.<\/em><\/p>\n<p><em>\u201cThe Biden Administration\u2019s dishwasher rule saved neither energy nor water. For families\u2014moms, dads, and kids who do laundry and dishes, this is a big win!
