Pfizer now claims the right of a corporate sovereign, arguing that states have \u201cno legitimate interest in regulating\u201d the company\u2019s commercial speech while demanding the power to censor Americans\u2019 newsfeeds.<\/strong><\/p>\n

<\/a><\/p>\n

The call for pharmaceutical supremacy came in Pfizer\u2019s\u00a0response<\/a>\u00a0to Texas Attorney General Ken Paxton\u2019s suit alleging that\u00a0Pfizer committed fraud<\/a>\u00a0and \u201cconspired to censor public discourse.\u201d<\/p>\n

Pfizer embraces its merger with the state when convenient, arguing that it cannot be held liable for misleading the public on its Covid vaccine because the company \u201cacted pursuant to its contract with the United States Government.\u201d<\/p>\n

The court documents insist that the\u00a0PREP<\/a>\u00a0Act, invoked by President Trump\u2019s Secretary of Health and Human Services Alex Azar, provides complete immunity for Pfizer\u2019s Covid products.<\/strong><\/p>\n

While the PREP Act prevents citizens injured by the company\u2019s vaccines from recovering money damages in court, it does not nullify state laws concerning fraud.<\/p>\n

Pfizer\u2019s affinity for the state is reserved for the expansive legal favoritism awarded to Big Pharma, achieved through decades and billions of dollars in lobbying efforts.<\/strong><\/p>\n

The company insists that \u201cThe State of Texas has no legitimate interest in regulating Pfizer\u2019s truthful, non-misleading speech concerning the benefits of receiving the Covid-19 vaccine.\u201d Further, the brief calls Paxton\u2019s suit an \u201cattempt to punish Pfizer for spreading truthful, FDA-approved information educating the public regarding the Covid-19 vaccine.\u201d<\/p>\n

At no point, however, does Pfizer respond to Paxton\u2019s detailed allegations that the company\u2019s information was not truthful, but was instead a lucrative marketing campaign designed to \u201cdeceive the public.\u201d<\/p>\n

The filing does not deny Paxton\u2019s detailed allegations that Pfizer \u201ccoerced social media platforms to silence prominent truth-tellers,\u201d including a former FDA Director, and \u201cconspired to censor the vaccine\u2019s critics.\u201d<\/strong><\/p>\n

Pfizer Board Member\u00a0Scott Gottlieb<\/a>\u00a0\u201cpersistently contacted senior persons at Twitter and\u2026other social media platforms, in a clandestine effort to silence challengers to Pfizer\u2019s deceptive scheme to promote sales and use of its vaccine products,\u201d including targeting doctors who touted natural immunity, according to Paxton\u2019s suit.<\/p>\n

Further, Paxton alleges that Pfizer, led by CEO Albert Bourla, \u201caffirmatively intimidated vaccine skeptics to perpetuate its scheme to confuse and deceive the public.\u201d<\/strong><\/p>\n

The company makes no attempt to refute these allegations. Instead, the brief cites its government contracts as\u00a0carte blanche\u00a0<\/em>to take any actions related to Covid.<\/p>\n

Pfizer thus not only claims to work in tandem with the State, but it asserts a sovereign power unshackled from the restraints of constitutional law. <\/strong>The First Amendment allows its executives to usurp citizens\u2019 freedom of speech but prevents prosecution of the company\u2019s lies, according to this theory.<\/p>\n

This is an attempt to close one of the few existing (possible) legal avenues to hold pharmaceutical companies accountable. No doubt that the Biden administration, and all the kept federal agencies, will agree with this.<\/p>\n

When the courts stop working to hold the powerful accountable, where are the victims to turn next? How can we claim to live in a representative democracy when its citizens\u2019 paths for the redress of wrongs are deliberately closed for the benefit of its most powerful institutions?<\/strong><\/em><\/p>\n<\/div>\n
