The truth, which will come out in this case, is that the Times paid someone to hack OpenAI\u2019s products.\u201d\u00a0<\/em><\/p>\n<p>OpenAI\u2019s claim of \u201chacking\u201d is,\u00a0<a href=\"https:\/\/www.nytimes.com\/2024\/02\/27\/technology\/openai-new-york-times-lawsuit.html\">according<\/a>\u00a0to the newspaper\u2019s attorney Ian Crosby, merely an effort to use OpenAI\u2019s products to find evidence of the alleged theft and reproduction of The NYT\u2019s copyrighted work.<\/p>\n<p><a href=\"https:\/\/cms.zerohedge.com\/s3\/files\/inline-images\/4a5148cf-138a-4115-8451-f406cfa6.jpg?itok=Onk3DP6R\"><\/a><\/p>\n<p><em>Screenshot of the filing by OpenAI. Source: Courtlistener<\/em><\/p>\n<p>In December 2023, The NYT\u00a0<a href=\"https:\/\/cointelegraph.com\/news\/nyt-ai-case-vs-openai-microsoft-could-be-watershed-moment-community-responds\">filed a lawsuit against OpenAI<\/a>\u00a0and its leading financial supporter, Microsoft. The lawsuit alleges the unauthorized use of millions of NYT articles to train chatbots that provide information to users.<\/p>\n<p>The lawsuit pulled from both the United States Constitution and the Copyright Act to defend the original journalism of The NYT. It also pointed to Microsoft\u2019s Bing AI, alleging that it creates verbatim excerpts from its content.<\/p>\n<p>The New York Times is among many copyright holders suing tech firms for supposedly misusing their content in AI training.\u00a0<a href=\"https:\/\/cointelegraph.com\/news\/meta-and-open-ai-sued-for-copyright-violations-sarah-silverman\">Other groups, like authors<\/a>, visual artists and music publishers, have also filed similar lawsuits.<\/p>\n<p>OpenAI has previously asserted that training advanced AI models\u00a0<a href=\"https:\/\/cointelegraph.com\/news\/new-york-times-vs-open-ai-artificial-intelligence-worst-that-could-happen\">without utilizing copyrighted works is \u201cimpossible.<\/a>\u201d In a filing to the United Kingdom House of Lords, OpenAI stated that, as copyright covers a wide range of human expressions, training leading AI models would be infeasible without incorporating copyrighted materials.<\/p>\n<p>Tech firms argue that their\u00a0<a href=\"https:\/\/cointelegraph.com\/news\/what-is-fair-use-us-supreme-court-weighs-in-on-ai-s-copyright-dilemma\">AI systems use copyrighted material fairly<\/a>,\u00a0emphasizing that these lawsuits threaten the potential multitrillion-dollar industry\u2019s growth.<\/p>\n<p>Courts have yet to determine if AI training is considered fair use under copyright law.
