It would also prohibit \u201cslavery in any form.\u201d<\/p>\n<p><em><strong>\u201cForced labor has no redeeming qualities and is inconsistent with California\u2019s respect for human dignity,\u201d <\/strong><\/em>the amendment reads.<\/p>\n<p>The measure was introduced by Democratic Assemblymember Lori Wilson in February 2023. It passed June 27 in the Senate with only three opposition votes from Republican Sens. Brian Dahle, Roger Niello, and Kelly Seyarto.<\/p>\n<p>Their offices were not available for comment.<\/p>\n<p>The measure passed the same day 68\u20130 in the Assembly.<\/p>\n<p><em><strong>\u201cThis historic measure will now be presented to the voters of California, giving them the power to decide on ending slavery and involuntary servitude in our state Constitution,\u201d <\/strong><\/em>Ms. Wilson said in a <a href=\"https:\/\/a11.asmdc.org\/press-releases\/20240627-assemblywoman-lori-d-wilsons-statement-passage-aca-8-both-senate-and\">statement<\/a> Thursday after the two votes.<\/p>\n<p>ACLU California Action argued in a position <a href=\"https:\/\/aclucalaction.org\/bill\/aca-8\/\">statement<\/a>, in favor of the amendment, that the <a href=\"https:\/\/www.archives.gov\/milestone-documents\/13th-amendment#:~:text=The%2013th%20Amendment%20to%20the%20United%20States%20Constitution%20provides%20that,place%20subject%20to%20their%20jurisdiction.%22\">13th Amendment<\/a> of the U.S. Constitution failed in abolishing slavery.<\/p>\n<p><em><strong>\u201cHundreds of thousands of people are still living in involuntary servitude due to an \u2018exception clause\u2019 that allows free labor for punishment of a crime,\u201d<\/strong><\/em> they wrote.<\/p>\n<p>The possible amendment of the California Constitution is part of the \u201cReparations Priority Bill Package\u201d introduced by the California Legislative Black Caucus in January.<\/p>\n<p><strong>The package includes <a href=\"https:\/\/blackcaucus.legislature.ca.gov\/news\/california-legislative-black-caucus-introduces-2024-reparations-legislative-package\">14 bills<\/a> centered on civil rights, criminal justice reform, and health and business matters for black Californians written in response to a <a href=\"https:\/\/oag.ca.gov\/ab3121\/report\">2023 report<\/a> from the state\u2019s Reparations Task Force, tasked by the Legislature to survey \u201congoing and compounding harms experienced by African Americans as a result of slavery.\u201d<\/strong><\/p>\n<p>The report offered statewide reparations recommendations.<\/p>\n<p>Legal Services for Prisoners with Children, an <a href=\"https:\/\/prisonerswithchildren.org\/caslave\/\">advocacy group<\/a> working to end what it calls structural racism in the justice system, has also supported ACA 8.<\/p>\n<p><em><strong>\u201cFor the first time in California\u2019s tarnished history around slavery, Black Americans and Indigenous people will be able to vote against slavery,\u201d <\/strong><\/em>the organization wrote in a statement.<\/p>\n<p>Although the bill had broad support among lawmakers, there are some criticisms.<\/p>\n<p>Brian James, a former California state prison inmate who spent 29 years behind bars after being convicted of second-degree murder, said he disagrees with the measure.<\/p>\n<p><em><strong>\u201cI believe work should be enforced,\u201d <\/strong><\/em>he told The Epoch Times July 2.<\/p>\n<p>Released in 2022, Mr. James, who also recently appeared on EpochTV\u2019s \u201cCalifornia Insider\u201d on the topic of prison life, said working was an integral part of being incarcerated and said inmates are needed to do tasks like yard maintenance, plumbing work, electrical work, and cooking.<\/p>\n<p><em><strong>\u201cInmates run the entire facility,\u201d<\/strong><\/em> he said.<\/p>\n<p>Most convicted persons enter prison and are assigned jobs based on their education and experience, he said.<\/p>\n<p><em><strong>\u201cIf you don\u2019t have a high school diploma, they will put you in school,\u201d<\/strong><\/em> he said.<\/p>\n<p>He described prison labor as \u201ca point of dignity\u201d rather than slavery.
