{"id":1482015,"date":"2024-08-06T22:50:00","date_gmt":"2024-08-07T02:50:00","guid":{"rendered":"https:\/\/bugaluu.com\/news\/?p=1482015"},"modified":"2024-08-06T22:50:00","modified_gmt":"2024-08-07T02:50:00","slug":"elon-musk-revives-lawsuit-against-openai-and-co-founders","status":"publish","type":"post","link":"https:\/\/bugaluu.com\/news\/elon-musk-revives-lawsuit-against-openai-and-co-founders\/1482015\/","title":{"rendered":"Elon Musk Revives Lawsuit Against OpenAI And Co-Founders"},"content":{"rendered":"<p><span class=\"field field--name-title field--type-string field--label-hidden\">Elon Musk Revives Lawsuit Against OpenAI And Co-Founders<\/span><\/p>\n<div class=\"clearfix text-formatted field field--name-body field--type-text-with-summary field--label-hidden field__item\">\n<p><a href=\"https:\/\/www.theepochtimes.com\/us\/elon-musk-revives-lawsuit-against-openai-and-co-founders-5700549?utm_source=partner&amp;utm_campaign=ZeroHedge\"><em>Authored by Chase Smith via The Epoch Times,<\/em><\/a><\/p>\n<p><strong>Elon Musk, the CEO of Tesla, X, and SpaceX, has reignited a legal battle against OpenAI and its co-founders, Sam Altman and Greg Brockman, months after initially dropping his lawsuit.<\/strong><\/p>\n<p><a href=\"https:\/\/cms.zerohedge.com\/s3\/files\/inline-images\/image%20%2841%29_3.jpg?itok=siyW-9HE\"><\/a><\/p>\n<p>The revived <a href=\"https:\/\/www.courthousenews.com\/wp-content\/uploads\/2024\/08\/elon-musk-v-sam-altman-complaint.pdf\">complaint<\/a>, filed Aug. 5 in the U.S. District Court for the Northern District of California, accuses the defendants of multiple counts, including fraud, breach of contract, and violations of federal civil racketeering laws.<\/p>\n<p><strong>Musk had originally sued in February before <a href=\"https:\/\/www.theepochtimes.com\/us\/elon-musk-files-motion-to-withdraw-lawsuit-against-openai-5667351\">dropping<\/a> the suit in June with no explanation given at the time.<\/strong><\/p>\n<p>Musk\u2019s revived lawsuit includes several allegations against OpenAI, Altman, and Brockman\u2014at the heart of which is a claim that Altman and Brockman \u201cintentionally courted and deceived\u201d Musk into co-founding OpenAI under false pretenses.<\/p>\n<p>Musk asserted in the 81-page suit that he was misled into believing that OpenAI would be a nonprofit organization focused on developing artificial intelligence (AI) technologies \u201cfor the benefit of humanity,\u201d operating as a counterbalance to for-profit tech giants.<\/p>\n<p><strong>According to the lawsuit, OpenAI\u2019s co-founders allegedly manipulated Musk by making repeated promises and assurances that the organization would remain open-source and not driven by profit.<\/strong><\/p>\n<p>The suit defines \u201copen source\u201d as the practice of making AI technology and research freely accessible to the public, allowing for transparency and collaboration.<\/p>\n<p><em><strong>\u201cAltman assured Musk that the non-profit structure guaranteed neutrality and a focus on safety and openness for the benefit of humanity, not shareholder value,\u201d the suit claimed. \u201cBut as it turns out, this was all hot-air philanthropy\u2014the hook for Altman\u2019s long con.\u201d<\/strong><\/em><\/p>\n<p>Musk claims that these representations were part of a scheme to attract significant funding and expertise, which he provided, including \u201ctens of millions of dollars\u201d and the recruitment of top AI scientists.<\/p>\n<p>The complaint further accuses Altman and Brockman of<strong> engaging in \u201crampant self-dealing\u201d and transforming OpenAI into a for-profit entity<\/strong> in partnership with Microsoft, thereby abandoning its original mission.<\/p>\n<p>Musk argued that OpenAI\u2019s pivot to a for-profit model has resulted in substantial unjust enrichment for the defendants, which he contends was at the expense of the nonprofit\u2019s mission.<\/p>\n<h2>Company Responds to Lawsuit<\/h2>\n<p>OpenAI responded to the latest legal filing in a statement.<\/p>\n<p><em><strong>\u201cAs we said about Elon\u2019s initial legal filing, which was subsequently withdrawn, Elon\u2019s prior emails continue to speak for themselves,\u201d a spokesperson for the company told The Associated Press in an emailed statement.<\/strong><\/em><\/p>\n<p>In March, OpenAI released emails purportedly written by Musk showing initial support for making the company for-profit to secure the necessary funding to compete with Google DeepMind. Musk also supported the idea of merging OpenAI with Tesla.<\/p>\n<p><em>\u201cWe may wish it otherwise, but, in my and [redacted]\u2019s opinion, Tesla is the only path that could even hope to hold a candle to Google. Even then, the probability of being a counterweight to Google is small.
