{"id":1485980,"date":"2024-08-26T11:45:00","date_gmt":"2024-08-26T15:45:00","guid":{"rendered":"https:\/\/bugaluu.com\/news\/?p=1485980"},"modified":"2024-08-26T11:45:00","modified_gmt":"2024-08-26T15:45:00","slug":"teacher-fired-after-alleged-jan-6-involvement-wins-wrongful-termination-lawsuit","status":"publish","type":"post","link":"https:\/\/bugaluu.com\/news\/teacher-fired-after-alleged-jan-6-involvement-wins-wrongful-termination-lawsuit\/1485980\/","title":{"rendered":"Teacher Fired After Alleged Jan. 6 Involvement Wins Wrongful Termination Lawsuit"},"content":{"rendered":"<p><span class=\"field field--name-title field--type-string field--label-hidden\">Teacher Fired After Alleged Jan. 6 Involvement Wins Wrongful Termination Lawsuit<\/span><\/p>\n<div class=\"clearfix text-formatted field field--name-body field--type-text-with-summary field--label-hidden field__item\">\n<p><em>By Dave Huber of <a href=\"https:\/\/www.thecollegefix.com\/teacher-fired-after-alleged-jan-6-involvement-wins-wrongful-termination-lawsuit\/\">The College Fix<\/a><\/em><\/p>\n<p>A Pennsylvania teacher who was fired for allegedly attending the U.S. Capitol \u201cinsurrection\u201d on January 6, 2021, has <a href=\"https:\/\/apnews.com\/article\/allentown-pennsylvania-teacher-jan-6-lawsuit-0941e45d580cac29d44986db58aca0d9\">won<\/a> a wrongful termination lawsuit after a two-week trial.<\/p>\n<p>Jason Moorehead, a 17-year veteran social studies instructor in the Allentown School District, had always <a href=\"https:\/\/www.wfmz.com\/news\/area\/lehighvalley\/lehigh-county\/allentown-area\/fired-allentown-middle-school-teacher-prevails-in-federal-trial\/article_03f7d210-5d74-11ef-8589-1340729fc1c8.html?utm_medium=social&amp;utm_source=twitter_69News\">maintained<\/a> he was \u201cat all times over a mile away\u201d at the Washington Monument when the riot occurred.<\/p>\n<p>But on Jan. 7, the district issued a <a href=\"https:\/\/jbs.org\/assets\/sites\/2\/Allentown-Supers-PDF.pdf\">news release<\/a> stating a district employee \u201cwas involved in the electoral college protest.\u201d In it, Superintendent Thomas Parker did note the district \u201chas an obligation to respect the First Amendment rights of our staff.\u201d<\/p>\n<p>District Solicitor John Freund also <a href=\"https:\/\/www.thecollegefix.com\/pennsylvania-school-district-cans-teacher-who-participated-in-washington-dc-protest\/\">had said<\/a> \u201conly after knowing all the facts\u201d could the district act in a manner that \u201cbalances First Amendment rights with the higher standards set for public school teachers.\u201d<\/p>\n<p>These standards include \u201cteachers\u2019 duty not to participate in or advocate un-American or subversive doctrines.\u201d<\/p>\n<p><em><a href=\"https:\/\/www.lehighvalleynews.com\/allentown\/jury-awards-131-500-to-ex-allentown-teacher-in-lawsuit-over-jan-6-stop-the-steal-rally\">Lehigh Valley News.com<\/a><\/em> reports the district also \u201csaw [Moorehead\u2019s] light-hearted comments\u201d on social media about the happenings at the Capitol.<\/p>\n<p>For example, in response to a post which said \u201cDon\u2019t worry everyone, the Capitol is insured,\u201d Moorehead wrote \u201cThis!\u201d The remark is a reference to those who said <a href=\"https:\/\/www.washingtonexaminer.com\/opinion\/463933\/no-insurance-wont-save-the-businesses-destroyed-by-anti-police-riots\/\">the same thing<\/a> about the <a href=\"https:\/\/www.axios.com\/2020\/09\/16\/riots-cost-property-damage\">most destructive<\/a> riots in U.S. history following the killing of George Floyd.<\/p>\n<p>Although Moorehead wasn\u2019t specifically named in the district statement, \u201coutraged members of the public soon identified him\u201d <a href=\"https:\/\/www.thecollegefix.com\/pennsylvania-school-district-cans-teacher-who-participated-in-washington-dc-protest\/\">as the alleged culprit<\/a>. Some posted Moorehead\u2019s picture and home address on social media.<\/p>\n<p>On X (then Twitter), the account CROH Lehigh Valley (the first four letters standing for \u201cCommunity Research Opposing Hate\u201d) <a href=\"https:\/\/x.com\/crohlv\/status\/1374356354266193922\">posted<\/a> that Moorehead \u201cwas identified as an attendee of the J6 Capitol coup attempt\u201d and that \u201chis presence is enough reason for him to never teach #Allentown students ever again.\u201d<\/p>\n<p>It added \u201cStudents cannot be safe in a classroom with a fascist.\u201d<\/p>\n<p>It\u2019s been 75 days since <a href=\"https:\/\/twitter.com\/AllentownSD?ref_src=twsrc%5Etfw\">@AllentownSD<\/a> *social studies* teacher Jason Moorehead was identified as an attendee of the J6 Capitol coup attempt. His presence is enough reason for him to never teach <a href=\"https:\/\/twitter.com\/hashtag\/Allentown?src=hash&amp;ref_src=twsrc%5Etfw\">#Allentown<\/a> students ever again. Students cannot be safe in a classroom with a fascist. <a href=\"https:\/\/t.co\/JTPzxyngMs\">pic.twitter.com\/JTPzxyngMs<\/a><\/p>\n<p>\u2014 CROH Lehigh Valley (@crohlv) <a href=\"https:\/\/twitter.com\/crohlv\/status\/1374356354266193922?ref_src=twsrc%5Etfw\">March 23, 2021<\/a><\/p>\n<p>During the investigation, Moorehead was \u201cquestioned extensively\u201d by district officials where, again, he insisted he was nowhere near the Capitol.<\/p>\n<p>At the trial, the district claimed it had \u201cattempted\u201d to reinstate Moorehead \u2014 as long as he took a \u201ccultural sensitivity\u201d course. Moorehead refused, alleging the district had \u201ccreated an unsafe, hostile work environment.\u201d<\/p>\n<p>He then was terminated.<\/p>\n<p>Moorehead filed suit claiming the district and several school board members had violated his civil rights (\u201cfor besmirching his name\u201d due to his conservative political leanings) and for illegally suspending him based on the teachers union collective bargaining agreement.<\/p>\n<p>On Aug. 16, a jury awarded Moorehead $131,500, most of which will come from the district.
