It chose a different path. <\/strong>Now, <strong>Democrats are free to double down on the Biden-Harris administration\u2019s massive censorship enterprise.<\/strong><\/p>\n<p><a href=\"https:\/\/cms.zerohedge.com\/s3\/files\/inline-images\/trump%20kamala.jpg?itok=WGiahzm_\"><\/a><\/p>\n<p>There is every indication they intend to do so.\u00a0<\/p>\n<p><strong>The bedrock of American democracy, the First Amendment, prohibits Congress from making laws \u201cabridging the freedom of speech, or of the press.\u201d<\/strong> The prohibition also applies to <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/582\/15-1293\/#tab-opinion-3749203\">executive actions<\/a> and <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/268\/652\/\">state<\/a> <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/283\/359\/\">governments<\/a>. Until recently, there was bipartisan agreement on the centrality of free speech to American liberties. Today, nearly a <a href=\"https:\/\/www.thefire.org\/research-learn\/national-speech-index-january-2024-topline-results\">third<\/a> of Americans believe free speech rights go too far.<\/p>\n<p>When Donald Trump was elected president, Democrats in Congress threatened social media platforms with antitrust actions and repeal of the libel protections in Section 230 of the Communications Decency Act if they failed to rein in conservative speech. <strong>When Joe Biden took office, the federal government <a href=\"https:\/\/www.nationalreview.com\/2023\/09\/the-biden-administrations-escalating-campaign-against-free-speech\/\">institutionalized<\/a> a censorship enterprise that coerced and collaborated with social media platforms to censor, suppress, and demonetize disfavored views.<\/strong><\/p>\n<p>The New York Times <a href=\"https:\/\/www.nytimes.com\/2020\/10\/13\/magazine\/free-speech.html\">acknowledges<\/a> the left has long sought to limit \u201cunfettered speech.\u201d Former president Barak Obama <a href=\"https:\/\/www.washingtonexaminer.com\/daily-memo\/1030963\/obamas-partisan-disinformation-campaign\/\">told<\/a> a Stanford University conference that government controls must be imposed to stop so-called \u201cdisinformation.\u201d Vice President Kamala Harris <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2022\/06\/16\/fact-sheet-presidential-memorandum-establishing-the-white-house-task-force-to-address-online-harassment-and-abuse\/\">announced<\/a> a White House task force to block disinformation involving women\u2019s issues. Democrat vice presidential candidate Tim Walz told MSNBC, \u201cThere\u2019s no guarantee to free speech on misinformation or hate speech.\u201d In fact,<strong> both are generally <a href=\"https:\/\/americanmind.org\/salvo\/ending-free-speech\/\">protected<\/a> by the First Amendment. The Democrat <a href=\"https:\/\/democrats.org\/where-we-stand\/party-platform\/\">platform<\/a> sees controlling disinformation as a priority.<\/strong><\/p>\n<p>By contrast, in July, the Republicans adopted a <a href=\"https:\/\/www.presidency.ucsb.edu\/documents\/2024-republican-party-platform\">platform<\/a> that states: \u201cWe will ban the Federal Government from colluding with anyone to censor Lawful Speech, defund institutions engaged in censorship, and hold accountable all bureaucrats involved with illegal censoring. We will protect Free Speech online.\u201d<\/p>\n<p><strong>In <em>Murthy v. Missouri<\/em>, healthcare professionals, Missouri, and Louisiana <a href=\"https:\/\/www.nationalreview.com\/2022\/09\/biden-administration-engaged-in-a-massive-censorship-campaign\/\">sued<\/a> to block the Biden-Harris censorship regime.<\/strong> During discovery, officials testified that they knowingly sought to end-run the prohibitions on government interference in free speech by working with and through third parties, including Stanford, non-profit associations, and social media companies. After reviewing extensive discovery,<strong> U.S. District Court Judge Terry Doughty <a href=\"https:\/\/americanmind.org\/salvo\/ending-free-speech\/\">found<\/a> that the Biden-Harris administration had engaged in \u201ca broad pressure campaign <\/strong>designed to coerce social media companies into suppressing speakers, viewpoints, and content disfavored by the government\u201d and issued an injunction to stop it. A <a href=\"https:\/\/americanmind.org\/salvo\/biden-censorship-plans-take-major-hit\/\">unanimous panel<\/a> of the Fifth Circuit Court of Appeals agreed with the findings but tailored the injunction to eliminate ambiguities and exclude some agencies.<\/p>\n<p>Florida and Texas then passed laws to make it more difficult for social media platforms to ban political speech. The 11th Circuit struck down Florida\u2019s law, finding that it impermissibly limited editorial discretion, while the Fifth Circuit upheld Texas\u2019 law, concluding that content moderation activities are not speech.<\/p>\n<p><strong>Last term, the Supreme Court weighed in on both cases.<\/strong><\/p>\n<p>In <em><a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/23-411_3dq3.pdf\">Murthy v. Missouri<\/a>,<\/em> a 6-3 Court overruled the Fifth Circuit, holding that the plaintiffs lacked standing because they failed to demonstrate that their speech was specifically censored by specified actions of identified government officials. The majority <a href=\"https:\/\/americanmind.org\/salvo\/big-brother-biden\/\">found<\/a>\u00a0that the platforms had independent incentives to censor content, \u201coften\u201d exercised their own judgment, and likely would have censored the same content without government coercion or encouragement.<\/p>\n<p>In <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/22-277_d18f.pdf\"><em>Moody v. NetChoice, LLC<\/em><\/a><em>,<\/em> the court unanimously decided that the Florida and Texas appeals courts had inadequately analyzed the First Amendment. It sent the cases back for reconsideration, though warning the Fifth Circuit that content moderation usually involves editorial decisions protected by the First Amendment.<\/p>\n<p>The court\u2019s use of the left\u2019s preferred euphemism, \u201ccontent moderation,\u201d in these decisions, rather than \u201ccensor\u201d or \u201csuppress,\u201d is troubling. And, while the court is properly wary of states intruding in the editorial choices made by social media platforms, it expressed no similar concern about the federal government. <strong><em>Murthy<\/em> was inconsistent with <em>NetChoice<\/em>, precedent, and the evidentiary record.<\/strong><\/p>\n<p>In <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/373\/244.html\"><em>P<\/em><em>e<\/em><em>t<\/em><em>e<\/em><em>rson v. City of Greenville<\/em><\/a> (1963), the court held that when the government strongly involves itself in a private party\u2019s conduct, it cannot claim the conduct occurred as a result of private choice, even if the private party would have acted independently. In <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/413\/455\/#tab-opinion-1950417\"><em>Norwood v. Harrison<\/em><\/a> (1973), Chief Justice Warren Burger explained that the government \u201cmay not induce, encourage, or promote private persons to accomplish what it is constitutionally forbidden to accomplish.\u201d In <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/419\/345\/\"><em>Jackson v. Metropolitan Edison Co.<\/em><\/a> (1974) and <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/457\/991\/\"><em>Blum v. Yaretsky<\/em><\/a> (1982), the court developed guidelines for when government becomes responsible for private actions by coercing or \u201csignificantly encouraging\u201d those actions. In his concurring opinion in <a href=\"https:\/\/www.law.cornell.edu\/supremecourt\/text\/20-197\"><em>Biden v. Knight First Amendment Institute at Columbia Univ<\/em><\/a><em>.<\/em> (2021), <strong>Justice Clarence Thomas summarized: \u201cThe government cannot accomplish through threats of adverse government action what the Constitution prohibits it from doing directly.\u201d<\/strong><\/p>\n<p>Since the court\u2019s ruling in <em>Murthy, <\/em>the Biden-Harris administration has ramped up its censorship enterprise. A July <a href=\"https:\/\/oig.justice.gov\/sites\/default\/files\/reports\/24-080.pdf\">report<\/a> from the Justice Department recycles the same justification of malign foreign influence it used in defending <em>Murthy<\/em> to again authorize DOJ collaboration with social media platforms to suppress disfavored postings. Last week, <a href=\"https:\/\/www.foxnews.com\/media\/wapo-reporter-suggests-white-house-censor-misinformation-trump-musk-interview-press-briefing\">referring<\/a> to Elon Musk\u2019s interview with Donald Trump on X, White House Press Secretary Karine Jean-Pierre channeled former Press Secretary Jen Psaki, asserting that social media companies have a \u201cresponsibility\u201d to stop disinformation and misinformation.<\/p>\n<p><strong>Though the Court\u2019s rulings leave an opportunity for future plaintiffs to more carefully link coercion to specific instances of censorship, unless Republicans win in November, government-encouraged censorship of conservatives will only get worse.<\/strong><\/p>\n<p><em>Kenin M.
