UK High Court Revokes Permit For First Coal Mine In 30 Years<\/span><\/p>\n

London\u2019s High Court on Friday\u00a0quashed<\/a>\u00a0a planning permission for the UK\u2019s first new coal mine in three decades, ruling that the permit was unlawful as it hadn\u2019t considered the emissions from burning the fuel.\u00a0<\/strong><\/em><\/p>\n

Earlier this year, climate campaigners, including Friends of the Earth,\u00a0challenged<\/a>\u00a0the approval of the coal mining project.<\/p>\n

The UK\u2019s previous Conservative government approved in December 2022 the Woodhouse Colliery\u00a0project<\/a>\u00a0in Whitehaven, northwest England, developed by West Cumbria Mining.\u00a0\u00a0<\/p>\n

The project to mine metallurgical coal, the one used for steelmaking, will be required to support steelmaking throughout the transition to Net Zero over the next few decades, <\/strong>WCM\u00a0said<\/a>\u00a0at the end of 2023.<\/p>\n

<\/a><\/p>\n

However, the new Labour government in the UK pulled in July its support for the project <\/strong>and said that it would no longer defend the case at High Court.<\/p>\n

The UK\u2019s new Secretary of State for Housing, Communities and Local Government, Angela Rayner,\u00a0has accepted<\/a>\u00a0there was an \u201cerror of law\u201d in the approval from December 2022.\u00a0<\/p>\n

The government\u2019s move to drop its defense of the project follows a\u00a0landmark Supreme Court judgment<\/a>\u00a0from June 2024, which ruled that a local council unlawfully granted approval to an onshore oil drilling project as planners must have considered the emissions from the oil\u2019s future use as fuels, in a landmark case that could upset new UK fossil fuel projects.<\/p>\n

Today the High Court\u00a0agreed<\/a>\u00a0with the legal challenges that the lifetime emissions of the proposed Whitehaven mine, mostly from burning coal, were not properly considered and the approval was unlawful.\u00a0<\/p>\n

\u201cWe have to leave fossil fuels in the ground and build the cleaner, brighter future that will slash emissions, cut bills and create the well-paid jobs of tomorrow that areas like West Cumbria so urgently need,\u201d <\/strong><\/em>said Niall Toru, senior lawyer at Friends of the Earth.\u00a0\u00a0<\/p>\n<\/div>\n
