Or, rather, we are about to sort it out again, on September 30, in Berlin Superior Court.<\/p>\n<p><strong>We already sorted it out once, in January, in District Court, where I was summarily acquitted, following which, for a few weeks, it wasn\u2019t a \u201chate crime.\u201d <\/strong>But the Hate-Crime Commissar of New Normal Berlin wasn\u2019t happy about that verdict, so she appealed to have it overturned, whereupon it became a \u201chate crime\u201d again, or an alleged \u201chate crime,\u201d or whatever it is, currently.<\/p>\n<p>OK, I\u2019m going to go ahead and re-perpetrate my \u201chate crime,\u201d or alleged \u201chate crime,\u201d or whatever its legal status actually is at the moment. I want to get that out of the way now so I don\u2019t go off on a tangent and forget to do it later. If you don\u2019t want be a party to that, this would be the time to click away.<\/p>\n<p><strong>Still with me? That\u2019s my \u201chate crime\u201d \u2026 those two Tweets from 2022, criticizing the Covid mask mandates.<\/strong> I\u2019m not going to bother translating them again and going over all the details of my prosecution. I have done that ad nauseam. There is only so much repetition my regular readers can take. Her official title, in German, is \u201cOberstaatsanw\u00e4ltin als Hauptabteilungsleiterin der Zentralstelle Hasskriminalit\u00e4t Berlin,\u201d which basically means \u201cSenior Public Prosecutor and Head of the Berlin\u00a0<a href=\"https:\/\/www.berlin.de\/staatsanwaltschaft\/zentralstelle-hasskriminalitaet\/\">Central Hate Crime Office<\/a>.\u201d<\/p>\n<p>Senior Public Hate-Crime Prosecutor Ines Karl began her distinguished prosecutorial career back in the GDR, i.e., the German Democratic Republic, the judiciary of which convicted roughly 200,000 people of political crimes during its 40-year existence.<\/p>\n<p>I couldn\u2019t find any details about her distinguished prosecutions during her GDR days, but\u00a0<em>Der Tagesspiegel<\/em>, a German newspaper, did a profile of her in 2021, and assured us that Karl had been \u201clengthily reviewed\u201d before being allowed to prosecute people and run \u201cHate-Crime Offices\u201d in the reunified Germany.<\/p>\n<p>Here\u2019s an excerpt from that piece [translation and emphasis mine] \u2026<\/p>\n<p><em>\u201cIn April, Ines Karl will have been a public prosecutor in Berlin Moabit for 30 years. She knew early on that this was her dream job \u2013 it almost came to an abrupt end with reunification. She grew up in Berlin-Mitte and Lichtenberg, studied Law in Jena in the 1980s, and worked as a public prosecutor in Wei\u00dfensee before the wall came down.\u00a0<strong>Only after a lengthy review process, including by the Judges\u2019 Election Committee and the Office for the Protection of the Constitution, was she allowed to continue the profession she learned and practiced in the GDR in the Federal Republic. The experiences of that time are still with her today, with mixed feelings.<\/strong>\u201d \u2014\u00a0<a href=\"https:\/\/background.tagesspiegel.de\/digitalisierung-und-ki\/briefing\/ines-karl\">Der Tagesspiegel<\/a>, 2021<\/em><\/p>\n<p>Given that Ines Karl was cleared by the Office for the Protection of the Constitution (i.e., Germany\u2019s domestic Intelligence agency), there is absolutely no reason to hold her East-German prosecutorial \u201cexperiences\u201d against her, or go fishing around in the GDR archive to determine the exact nature of those prosecutorial \u201cexperiences.\u201d<\/p>\n<p><strong>In fact, doing so would probably be a \u201chate crime.\u201d<\/strong><\/p>\n<p>So, I definitely won\u2019t be doing that. I\u2019ve got enough \u201chate crime\u201d troubles as it is.<\/p>\n<p>What I did, though, after I stumbled onto Senior Public Hate-Crime Prosecutor Ines Karl\u2019s background, was Google around a bit, you know, just to refresh my memory of other people\u2019s \u201cexperiences\u201d in the German Democratic Republic.<\/p>\n<p>One thing I found was this article in\u00a0<em>Deutsche Welle<\/em>\u00a0(<em><a href=\"https:\/\/www.dw.com\/en\/former-inmates-recall-life-in-erich-honeckers-gdr-prisons\/a-48311325\">East Germany\u2019s Tortured Political Prisoners<\/a>)<\/em>. Here\u2019s an excerpt [emphasis mine] \u2026<\/p>\n<p><em>\u201cThirty years after the fall of the Berlin Wall, there remain Germans who tout the legacy of the German Democratic Republic. The oft-heard claim that \u2018not everything was bad about the GDR\u2019 and that the Soviet-allied state had great day care facilities, as some still assert, strikes 68-year-old Manfred Wilhelm as utterly absurd. He was a political prisoner. In 1981,\u00a0<strong>Wilhelm was sentenced to eight and a half years behind bars for the crime of inciting hatred against the state\u00a0<\/strong>\u2014 just for telling a few political jokes to friends and in bars.\u201d<\/em><\/p>\n<p>So that made me feel a little better about being re-prosecuted by Senior Public Hate-Crime Prosecutor Karl, and being defamed, and having my reputation and income as author damaged. At least she\u2019s not looking to lock me up for eight years! Three years is the maximum sentence for my \u201chate crime.\u201d Or, I don\u2019t know, if she feels she really needs to send a message to other alleged \u201chate criminals,\u201d I guess she could count up all the times I\u2019ve published the Tweets that I just republished again above and charge me with multiple counts of my \u201chate crime.\u201d In fact, her office has already launched a second criminal investigation of me based on just that!<\/p>\n<p>Another thing I found while just idly Googling around, which didn\u2019t make me feel so much better, but maybe kind of explains a few things, was an article, in two different German outlets, in which Senior Public Hate-Crime Prosecutor Ines Karl was quoted referring to one of her colleagues\u2019 participation at a demonstration and his criticism of Germany\u2019s Covid measures on social-media networks as \u201ccrimes.\u201d<\/p>\n<p>Here\u2019s the quote [translation and emphasis mine] \u2026<\/p>\n<p><em>\u201cKarl emphasized that the debates about possible right-wing extremist attitudes in the security services were being \u2018monitored very closely.\u2019\u00a0<strong>The case of a Berlin public prosecutor who took part in the Corona-denier demonstrations and spread corresponding posts on social networks<\/strong>\u00a0is being extensively discussed in the public prosecutor\u2019s office, for example \u2018whether this should be socially acceptable here.\u00a0<strong>If such crimes are committed, investigations will also be carried out within our own ranks,\u2019 emphasized Karl.\u201d<\/strong>\u00a0\u2014\u00a0<a href=\"https:\/\/www.evangelisch.de\/inhalte\/179303\/03-12-2020\/berliner-oberstaatsanwaeltin-wir-brauchen-die-zivilgesellschaft\">Evangelisch Magazine<\/a>,\u00a0<a href=\"https:\/\/www.migazin.de\/2020\/12\/04\/rechtsextremismus-berliner-oberstaatsanwaeltin-wirbt-um-vertrauen\/\">MiGAZIN<\/a>, 2020<\/em><\/p>\n<p>The fact that Senior Public Hate-Crime Prosecutor Karl would refer to the expression of political dissent as a \u201ccrime,\u201d on the record, without a second thought, may explain why her office is unabashedly prosecuting me on fabricated \u201chate crime\u201d charges (i.e., using a swastika in my artwork), and not\u00a0<em>Der Spiegel<\/em>,\u00a0<em>Stern<\/em>, Karl Lauterbach, and many others, for doing exactly the same thing.<\/p>\n<p><a href=\"https:\/\/cms.zerohedge.com\/s3\/files\/inline-images\/httpssubstack-post-media.s3.amaz%20%2816%29_4.jpg?itok=zEh8neAK\"><\/a><\/p>\n<p>I don\u2019t want to impugn her competence as a Senior Public Hate-Crime Prosecutor or in any way suggest that the \u201clengthy review process\u201d of her understanding of the law (including the concept of \u201cthe rule of law\u201d in non-totalitarian societies) conducted by the Judges\u2019 Election Committee and the Office for the Protection of the Constitution prior to turning her loose on the public following the collapse of the GDR was \u2026 well, anything less than adequate, but, if Germany is going to continue to claim that it has any respect for basic democratic principles \u2014 not to mention its own constitution \u2014 someone might want to take Ines Karl aside and explain that political dissent is not a crime.<\/p>\n<p>Or, on second thought, maybe it is now. In which case, it would helpful if the German authorities would drop the \u201cGermany is a democratic state under the rule of law\u201d crap and just go openly totalitarian. It would certainly be less confusing.<\/p>\n<p>After all, in New Normal Germany, it is once again a crime to \u201cdelegitimize the state,\u201d as it was in East Germany and Nazi Germany. I reported this in May 2021 in a column called\u00a0<em><a href=\"https:\/\/cjhopkins.substack.com\/p\/the-criminalization-of-dissent\">The Criminalization of Dissent<\/a><\/em>, as did\u00a0<em>The New York Times<\/em>.<\/p>\n<p>Here\u2019s an excerpt from my column \u2026<\/p>\n<p>\u201cYes, that\u2019s right, in \u2018New Normal\u2019 Germany, if you dissent from the official state ideology, you are now officially a dangerous \u2018extremist.\u2019 The German Intelligence agency (the \u2018BfV\u2019) has even invented a new category of \u2018extremists\u2019 in order to allow themselves to legally monitor\u00a0<strong>anyone suspected of being \u2018anti-democratic and\/or delegitimizing the state in a way that endangers security\u2019<\/strong>\u00a0\u2026 I\u2019m not joking. Not even slightly. The Federal Office for Protection of the Constitution (\u2018Bundesamt f\u00fcr Verfassungsschutz\u2019) is actively monitoring anyone questioning or challenging the official \u2018New Normal\u2019 ideology \u2026 the \u2018Covid Deniers,\u2019 the \u2018conspiracy theorists,\u2019 the \u2018anti-vaxxers,\u2019 the dreaded \u2018Querdenkers,\u2019 and anyone else they feel like monitoring who has refused to join the\u00a0<a href=\"https:\/\/consentfactory.org\/2021\/04\/21\/the-covidian-cult-part-ii\/\">Covidian Cult<\/a>. We\u2019re now official enemies of the state, no different than any other \u2018terrorists\u2019 \u2026 or, OK, technically, a little different. As\u00a0<em>The New York Times<\/em>\u00a0reported last week (<em><a href=\"https:\/\/www.nytimes.com\/2021\/04\/28\/world\/europe\/germany-coronavirus-deniers-surveillance.html\">German Intelligence Puts Coronavirus Deniers Under Surveillance<\/a><\/em>), \u2018the danger from coronavirus deniers and conspiracy theorists does not fit the mold posed by the usual politically driven groups, including those on the far left and right, or by Islamic extremists.\u2019 Still, according to the German Interior Ministry, we diabolical \u2018Covid deniers,\u2019 \u2018conspiracy theorists,\u2019 and \u2018anti-vaxxers\u2019 have \u2018targeted the state itself, its leaders, businesses, the press, and globalism,\u2019 and have \u2018attacked police officers\u2019 and \u2018defied civil authorities.\u2019\u201d<\/p>\n<p>As I mentioned above, it\u2019s a bit confusing, the \u201cdelegitimizing-the-state as opposed to political dissent\u201d thing, and the selective-prosecution-of-\u201chate-crimes\u201d thing, and the German justice system, generally.<\/p>\n<p><a href=\"https:\/\/x.com\/CJHopkins_Z23\/status\/1830883930800558558\">I reached out to some of the German state media, and even to Marco Buschmann, the Minister of Justice<\/a>, and requested more clarity on the German justice system, and the \u201cIs Germany a totalitarian state again?\u201d question. Sadly, I have received no response.<\/p>\n<p><a href=\"https:\/\/cms.zerohedge.com\/s3\/files\/inline-images\/httpssubstack-post-media.s3.amaz%20%2817%29_4.jpg?itok=A43sQUtk\"><\/a><\/p>\n<p><strong>Maybe Senior Public Hate-Crime Prosecutor Ines Karl can help me out with that. In light of her \u201cexperiences\u201d as a prosecutor in the GDR, she probably has a pretty good understanding of how things work in totalitarian systems.<\/strong> And, if she needs to brush up on the \u201cdemocratic rights\u201d thing, she could have a look at\u00a0<a href=\"https:\/\/www.gesetze-im-internet.de\/englisch_gg\/englisch_gg.html\">Article 5, and Article 2, and Article 3, and Article 8, of the German constitution<\/a>.<\/p>\n<p>Or, I\u2019d be happy to go over those articles with her, personally. Perhaps she\u2019ll show up in court this time. Last time, she sent one of her junior colleagues who appeared to be a bit \u2026 well, under the weather, or on some sort of heavy medication, or maybe he had just emerged from a strenuous \u201cNew Normal\u201d struggle session.<\/p>\n<p>In any event, if you\u2019ve never witnessed a \u201chate-crime\u201d trial in New Normal Germany, and you don\u2019t mind being subjected to the anti-terrorism-style \u201cSecurity protocols\u201d that the Court has ordered in effect in the courtroom \u2014 not to discourage the public and the press from attending and reporting on the trial, of course, but on account of what the Superior Court describes as \u201cthe overall tense security situation\u201d \u2014 you\u2019re welcome to attend on September 30.<\/p>\n<p><strong>Be advised, though, I might commit a few more alleged \u201chate crimes,\u201d right there in the courtroom, assuming I\u2019m allowed to speak.<\/strong><\/p>\n<p>I\u2019m not sure what the rules are these days in terms of what we\u2019re allowed to say \u2026 which is kind of the point of this entire exercise, in case that wasn\u2019t already clear.<\/p>\n<p><strong>Oh well, I guess I\u2019ll take my chances.
