Gavin Newsom vetoed on Sunday a heavily debated <a href=\"https:\/\/www.theepochtimes.com\/us\/newsom-considering-californias-ai-regulation-bill-5716054\">bill<\/a> to regulate artificial intelligence (AI) approved by the Legislature in August.<\/p>\n<p><a href=\"https:\/\/cms.zerohedge.com\/s3\/files\/inline-images\/image%20%2868%29_3.jpg?itok=QKqKjW2y\"><\/a><\/p>\n<p><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202320240SB1047\">Senate Bill 1047<\/a>, the Safe and Secure Innovation for Frontier Artificial Intelligence Models Act, <a href=\"https:\/\/www.theepochtimes.com\/us\/california-bill-to-regulate-artificial-intelligence-heats-up-ai-debate-5706662\">raised the stakes<\/a> in the debate over AI regulations.<\/p>\n<p><strong>If Newsom had signed the bill into law, it would have required testing of AI models to ensure they don\u2019t lead to mass death, attacks on public infrastructure, or cyberattacks.<\/strong><\/p>\n<p>The legislation would have also created whistleblower protections, as well as a public cloud for the development of AI for the public good.<\/p>\n<p>SB 1047 would have also created the Board of Frontier Models, a California state entity, to monitor the development of AI models.<\/p>\n<p>Newsom thoroughly scrutinized the bill in his <a href=\"https:\/\/www.gov.ca.gov\/wp-content\/uploads\/2024\/09\/SB-1047-Veto-Message.pdf\">veto<\/a>, noting that it risks \u201ccurtailing the very innovation that fuels advancement in favor of public good.\u201d<\/p>\n<p>He also said the bill regulates AI in a blanket fashion and lacks empirical analysis of the real threats posed by AI.<\/p>\n<p><em><strong>\u201cA California-only approach may well be warranted\u2014especially absent federal action by Congress\u2014but it must be based on empirical evidence and science,\u201d<\/strong><\/em> he wrote.<\/p>\n<p>Newsom also took issue with the fact that the bill applies mainly to expensive AI models\u2014those that cost more than $100 million to develop or require more than a certain quantity of computing power to train. In the governor\u2019s view, inexpensive AI models could pose just as much of a threat to the public good or critical infrastructure.<\/p>\n<p><em><strong>\u201cSmaller, specialized models may emerge as equally or even more dangerous than the models targeted by SB 1047,\u201d<\/strong><\/em> Newsom wrote.<\/p>\n<p>The governor said the legislation could slow down advancements in the interest of the public good. For that reason, Newsom believes SB 1047 could give the public \u201ca false sense of security\u201d when it comes to AI.<\/p>\n<p>Additionally, Newsom said SB 1047 fails to consider whether an AI model is deployed in high risk environments or uses sensitive information.<\/p>\n<p>\u201cInstead, the bill applies stringent standards to even the most basic functions\u2014so long as a large system deploys it,\u201d Newsom wrote. <em><strong>\u201cI do not believe this is the best approach to protecting\u00a0 the public from real threats posed by the technology.\u201d<\/strong><\/em><\/p>\n<p>Newsom said that he believes California must pass a law to regulate AI, and that he remains \u201ccommitted to working with the Legislature, federal partners,\u201d and others in the state and nation to \u201cfind the appropriate path forward, including legislation and regulation.\u201d<\/p>\n<p>San Francisco Democratic Sen. Scott Wiener, the bill\u2019s author, said the veto was \u201ca missed opportunity for California to once again lead on innovative tech regulation\u201d and \u201ca setback for everyone who believes in oversight of massive corporations that are making critical decisions\u201d in regards to the use of AI.<\/p>\n<p>Supporters of the bill include Elon Musk, AI startup Anthropic, the Center for AI Safety, tech equity nonprofit Encode Justice, the National Organization for Women, as well as whistleblowers from AI company OpenAI, among others.<\/p>\n<p>Elon Musk\u2019s record of criticism for California lawmakers made his endorsement of SB 1047 a surprise.<\/p>\n<p><em><strong>\u201cThis is a tough call and will make some people upset, but, all things considered, I think California should probably pass the SB 1047 AI safety bill,\u201d<\/strong><\/em> he <a href=\"https:\/\/x.com\/elonmusk\/status\/1828205685386936567?s=46\">posted<\/a> on X, the social media platform he owns.<\/p>\n<p><em><strong>\u201cFor over 20 years, I have been an advocate for AI regulation, just as we regulate any product\/technology that is a potential risk to the public.\u201d<\/strong><\/em><\/p>\n<p>Other supporters include Service Employees International Union, the Latino Community Foundation, and SAG-AFTRA.<\/p>\n<p>An online poll conducted by the Artificial Intelligence Policy Institute from Aug. 4 to Aug. 5 <a href=\"https:\/\/theaipi.org\/april-voters-prefer-ai-regulation-over-self-regulation-2-2\/\">shows<\/a> that 65 percent of the 1,000 California voters who responded support SB 1047. The survey has a margin of error of 4.9 percentage points.<\/p>\n<p>Opponents of the bill included tech behemoths such as Google, Meta, and OpenAI, who said the bill would undermine the California economy and the AI industry.<\/p>\n<p>Several members of the California congressional delegation asked Newsom to veto the bill before the California Legislature passed it last month in a landslide vote.<\/p>\n<p>The California Chamber of Commerce <a href=\"https:\/\/x.com\/CalChamber\/status\/1840498084410999211\">celebrated<\/a> Newsom\u2019s veto.<\/p>\n<p><em><strong>\u201cWe are grateful to Governor Newsom for the veto of SB 1047. Regulatory efforts to promote #AI safety are critical, but SB 1047 missed the mark in key ways,\u201d<\/strong><\/em> wrote Chamber President &amp; CEO Jennifer Barrera.<\/p>\n<p><em><strong>\u201cAs a consequence, the bill would have stifled AI innovation, putting California\u2019s place as the global hub of innovation at tremendous risk.\u201d<\/strong><\/em><\/p>\n<p>In September, Newsom signed approximately a dozen bills on various AI regulations. One such bill, <a href=\"https:\/\/www.gov.ca.gov\/2024\/09\/17\/governor-newsom-signs-bills-to-combat-deepfake-election-content\/\">Assembly Bill 2655<\/a>, protects voters from deep fakes and people the use of their likeness by others without consent.<\/p>\n<p>Other bills require businesses to share information about how they use data to train generative AI models, as well as to supply tools so consumers can see whether or not a certain piece of media is made by humans or AI.<\/p>\n<p>The SB 1047 veto derails the California Legislature\u2019s efforts to align the state\u2019s AI regulation with the European Union\u2019s AI Act.<\/p>\n<p>In September 2023, Newsom issued an executive order instructing California agencies to perform risk assessments of the threats and vulnerabilities AI poses to California\u2019s critical infrastructure.<\/p>\n<p>The U.S. A.I Safety Institute, under the National Institute of Science Technology, is creating guidance on security risks.
