Judge Finds Newsom’s New California Deepfake Ban Unconstitutional<\/span><\/p>\n

A federal court judge issued a preliminary injunction against a two-week-old California law that effectively bans election-related deepfakes.<\/strong><\/p>\n

<\/a><\/p>\n

The law \u2014 AB 2839 \u2014 allowed any person to sue for damages over AI deepfakes within 120 days of an election and up to 60 days after if the perpetrator\u2019s post resembled a political candidate.\u00a0<\/p>\n

Judge John A. Mendez said artificial intelligence and deepfakes pose significant risks but\u00a0ruled<\/a>\u00a0that the law was \u201cunconstitutional\u201d as it likely violated the First Amendment.<\/p>\n

\u201cThe Court finds that AB 2839 is also unconstitutional under California\u2019s free speech provision.\u201d\u00a0<\/p>\n

The decision comes from a case involving Christopher Kohls, known as \u201cMr Reagan\u201d on X. Kohls created a controversial AI-altered campaign video in July mocking United States Vice President Kamala Harris that was later shared by X\u2019s executive chairman Elon Musk.<\/p>\n

A lawyer representing Kohls filed a lawsuit against California Attorney General Rob Bonta and Secretary of State Shirley N. Weber to block the new law a day after\u00a0California Governor<\/a>\u00a0Gavin Newsom signed it into law on Sept. 17.\u00a0<\/p>\n

The law allowed California judges to order distributors of\u00a0AI deepfakes<\/a>\u00a0to take them down or potentially face monetary penalties.<\/p>\n

Mendez said Kohls is \u201clikely to succeed on his state constitutional claim\u201d and granted the motion for a preliminary injunction on Oct. 2.<\/p>\n

\u201cMost of AB 2839 acts as a hammer instead of a scalpel, serving as a blunt tool that hinders humorous expression and unconstitutionally stifles the free and unfettered exchange of ideas which is so vital to American democratic debate.\u201d\u00a0<\/strong><\/em><\/p>\n

Mendez further\u00a0agreed<\/a>\u00a0with Kohls\u2019 lawyer that the\u00a0AI deepfake<\/a>\u00a0of Harris was merely \u201csatire\u201d that should be protected by the First Amendment.<\/p>\n

\u201cWhile a well-founded fear of a digitally manipulated media landscape may be justified, this fear does not give legislators unbridled license to bulldoze over the longstanding tradition of critique, parody, and satire protected by the First Amendment.\u201d<\/p>\n

AB 2839 is one of several new AI-related laws that has recently hit Newsom\u2019s desk.<\/p>\n

Newsom on Sept. 30 vetoed the Safe and Secure Innovation for Frontier Artificial Intelligence Models Act \u2014 SB 1047 \u2014 which proposed mandatory safety testing of AI models.<\/p>\n

Newsom said that \u201cwhile well-intentioned,\u201d SB 1047 could\u00a0place unnecessary restrictions<\/a>\u00a0on emerging AI companies in California.<\/p>\n<\/div>\n
