{"id":1501243,"date":"2024-11-08T19:10:00","date_gmt":"2024-11-09T00:10:00","guid":{"rendered":"https:\/\/bugaluu.com\/news\/?p=1501243"},"modified":"2024-11-08T19:10:00","modified_gmt":"2024-11-09T00:10:00","slug":"federal-agency-accuses-white-house-official-of-violating-hatch-act","status":"publish","type":"post","link":"https:\/\/bugaluu.com\/news\/federal-agency-accuses-white-house-official-of-violating-hatch-act\/1501243\/","title":{"rendered":"Federal Agency Accuses White House Official Of Violating Hatch Act"},"content":{"rendered":"<p><span class=\"field field--name-title field--type-string field--label-hidden\">Federal Agency Accuses White House Official Of Violating Hatch Act<\/span><\/p>\n<div class=\"clearfix text-formatted field field--name-body field--type-text-with-summary field--label-hidden field__item\">\n<p><a href=\"https:\/\/www.theepochtimes.com\/us\/federal-agency-accuses-white-house-official-of-violating-hatch-act-5756320?utm_source=partner&amp;utm_campaign=ZeroHedge\"><em>Authored by Sam Dorman via The Epoch Times,<\/em><\/a><\/p>\n<p>A federal investigative agency is requesting disciplinary action for Neera Tanden, who serves as one of President Joe Biden\u2019s domestic policy advisors, over her allegedly violating a law that prohibits solicitations for partisan political candidates.<\/p>\n<p><a href=\"https:\/\/cms.zerohedge.com\/s3\/files\/inline-images\/image%20-%202024-11-08T090151.513.jpg?itok=jsxk4CiX\"><\/a><\/p>\n<p>The agency, known as the U.S. Office of Special Counsel (OSC), <a href=\"https:\/\/osc.gov\/News\/Pages\/25-06-Hatch-Act-Complaint-White-House-Official.aspx\">announced<\/a> the complaint on Nov. 7 while highlighting recent posts Tanden made on the social media platform X. According to the agency\u2019s <a href=\"https:\/\/osc.gov\/Documents\/Hatch%20Act\/24.11.06%20Complaint%20for%20Disciplinary%20Action%20(Tanden)%20-%20for%20release.pdf\">complaint,<\/a> Tanden violated the Hatch Act by posting or reposting solicitations for donations to Vice President Kamala Harris\u2019s presidential campaign, as well as multiple Democratic congressional candidates.<\/p>\n<p><em><strong>\u201cCongress created a rule banning all federal employees from fundraising for political candidates,\u201c <\/strong><\/em>Special Counsel Hampton Dellinger said.<\/p>\n<p><em><strong>\u201cThe Hatch Act contains no escape hatch for White House officials.\u201d<\/strong><\/em><\/p>\n<p>The White House did not respond to The Epoch Times\u2019 request for comment before publishing time. According to <a href=\"https:\/\/www.politico.com\/news\/2024\/11\/07\/neera-tanden-x-post-special-counsel-00188224\">Politico<\/a>, White House spokesperson Andrew Bates said Tanden took \u201ccompliance with the Hatch Act seriously.\u201d<\/p>\n<p>Tanden <a href=\"https:\/\/www.theepochtimes.com\/us\/neera-tanden-appointed-domestic-policy-adviser-after-failed-omb-nomination-in-2021-5245555\">served<\/a> as White House staff secretary before Biden promoted her last year to be one of his domestic policy advisors. <strong>Biden had nominated her to lead his Office of Management and Budget, but she <a href=\"https:\/\/www.theepochtimes.com\/us\/bidens-embattled-omb-pick-neera-tanden-drops-out-of-confirmation-process-3717824\">backed out<\/a> amid scrutiny over other social media posts.<\/strong><\/p>\n<p>In its Nov. 6 complaint, the special counsel office said it notified the White House Counsel\u2019s Office on Aug. 30 that Tanden was in violation of the Hatch Act after her post two days prior promoting four candidates for the U.S. House of Representatives.<\/p>\n<p>Tanden eventually removed that post on Sept. 3 but two days later reposted a video of actor Michael Keaton asking for funds to support Sen. Bob Casey (D-Pa.) in his campaign for reelection, the complaint said. In September, subsequent posts from Tanden promoted solicitations for Democrat Lucas Kunce, who was running to unseat Sen. Josh Hawley (R-Mo.); Democratic House candidate Rebecca Cooke of Wisconsin; and Democratic House candidate Will Rollins of California.<\/p>\n<p><em><strong>\u201cEach of Tanden\u2019s three subsequent posts &#8230; was also made after Tanden was notified that making such posts violated the Hatch Act prohibition against soliciting political contributions,\u201d<\/strong><\/em> the OSC\u2019s complaint read.<\/p>\n<p>The OSC\u2019s complaint requested that the Merit Systems Protection Board (MSPB) penalize Tanden under a federal law that outlines removal, suspension, monetary fines, or \u201creprimand\u201d as potential punishments.<\/p>\n<p>Bates reportedly pointed to a <a href=\"https:\/\/osc.gov\/documents\/hatch%20act\/reports\/investigation%20of%20political%20activities%20by%20senior%20trump%20administration%20officials%20during%20the%202020%20presidential%20election.pdf\">2021 report<\/a> wherein the special counsel office raised constitutional concerns with the MSPB disciplining individuals directly appointed by the president. That report said that OSC \u201cmay not pursue disciplinary action through the MSPB\u201d for commissioned officers, or those appointed by the president, and Senate-confirmed presidential appointees.<\/p>\n<p><strong>For both types of appointees, the OSC said it \u201cmust report its findings to the president\u201d and allow the president to take appropriate action.<\/strong><\/p>\n<p>Reporting to the president was the course of action the OSC took in response to alleged Hatch Act violations by Kellyanne Conway, former counselor to then-President Donald Trump.
