Mandel Ngan\/AFP via Getty Images<\/em><\/a><\/p>\n<p>\u201cT<strong>he NCAA is intentionally and knowingly jeopardizing the safety and wellbeing of women by deceptively changing women\u2019s competitions into co-ed competitions<\/strong>,\u201d Paxton said in a <a href=\"https:\/\/www.texasattorneygeneral.gov\/news\/releases\/attorney-general-ken-paxton-sues-ncaa-protect-womens-sports-and-prevent-biological-men-deceptively\">statement<\/a> on Sunday. \u201cWhen people watch a women\u2019s volleyball game, for example, they expect to see women playing against other women\u2014not biological males pretending to be something they are not. Radical \u2018gender theory\u2019 has no place in college sports.\u201d<\/p>\n<p>Paxton argued in the <a href=\"https:\/\/www.texasattorneygeneral.gov\/sites\/default\/files\/images\/press\/NCAA%20DTPA%20Petition%20Filed.pdf\">lawsuit<\/a> that the NCAA\u2019s practice of allowing biological men who identify as women to play in women\u2019s sports violates the Texas Deceptive Trade Practices Act, which protects consumers from scams.<\/p>\n<p>In response to The Epoch Times\u2019 request for comment, an NCAA spokesperson said though the association doesn\u2019t comment on pending litigation, it will \u201ccontinue to promote Title IX, make unprecedented investments in women\u2019s sports and ensure fair competition in all NCAA championships.\u201d<\/p>\n<p>\u201c<strong>Most consumers know that a \u2018woman\u2019 means an adult human female,\u201d<\/strong> Paxton said, a definition that has been commonly understood \u201cthroughout human history,\u201d he noted.<\/p>\n<p>By allowing men to compete in women\u2019s college sports, the NCAA is robbing women of their earned positions and lying to consumers about the competitive nature of the sporting event, he said.<\/p>\n<p>\u201c<strong>When female athletes are forced to compete against men in women\u2019s sports, they are deprived of titles, records, medals, scholarships, and opportunities to win<\/strong>; opportunities to participate in a fair and safe environment; and the ancillary benefits that sports participation provides,\u201d he said in the lawsuit. \u201cConsumers do not purchase goods and services associated with women\u2019s sporting events to watch men steal medals and records from female programs.\u201d<\/p>\n<p><strong>In March, former college swimmer Riley Gaines and other female college athletes <a href=\"https:\/\/www.theepochtimes.com\/sports\/16-female-athletes-file-lawsuit-against-ncaa-for-allowing-trans-women-to-compete-5607937\">filed a lawsuit<\/a> against the NCAA for allowing men identifying as women to compete in women\u2019s sports.<\/strong><\/p>\n<p>In October, 26 college regents in Georgia <a href=\"https:\/\/www.theepochtimes.com\/us\/georgia-university-leaders-urge-ncaa-to-ban-transgender-athletes-in-womens-sports-5738046\">called on the NCAA<\/a> to ban men identifying as transgender athletes from women\u2019s college sports.<\/p>\n<p>In its \u201cTransgender Student-Athlete Participation <a href=\"https:\/\/www.ncaa.org\/sports\/2022\/1\/27\/transgender-participation-policy.aspx\">Policy<\/a>,\u201d updated in May 2024, the NCAA said it aligned with the student-athlete <a href=\"https:\/\/stillmed.olympics.com\/media\/Documents\/Beyond-the-Games\/Human-Rights\/IOC-Framework-Fairness-Inclusion-Non-discrimination-2021.pdf\">Olympic Movement<\/a>, which allows for \u201ctransgender student-athlete participation for each sport to be determined by the policy for the national governing body of that sport.\u201d<\/p>\n<p>If there\u2019s no national governing body for the sport, NCAA policy guidelines default to the International Olympic Committee\u2019s <a href=\"https:\/\/stillmed.olympic.org\/Documents\/Commissions_PDFfiles\/Medical_commission\/2015-11_ioc_consensus_meeting_on_sex_reassignment_and_hyperandrogenism-en.pdf\">policy criteria<\/a> and the <a href=\"https:\/\/ncaaorg.s3.amazonaws.com\/inclusion\/lgbtq\/INC_TransgenderStudentAthleteParticipationPolicy.pdf\">2010 NCAA policy<\/a>, in addition to a requirement that such athletes \u201cmeet the sport standard for documented testosterone levels\u201d before competing.<\/p>\n<p>On Dec. 20, the Department of Education withdrew its 2023 <a href=\"https:\/\/www.theepochtimes.com\/us\/department-of-education-withdraws-rule-on-transgender-athletes-in-school-sports-5780151\">proposed rule<\/a> that would have prohibited schools from banning male athletes who identify as women from participating in women\u2019s sports.<\/p>\n<p><strong>Citing the complexity of the public comments and legal battles, the department said it chose \u201cnot to regulate on this issue at this time.\u201d<\/strong><\/p>\n<p><em>Aldgra Fredly and Caden Pearson contributed to this report.<\/em><\/p>\n<\/div>\n<p>      <span class=\"field field--name-uid field--type-entity-reference field--label-hidden\"><a title=\"View user profile.\" href=\"https:\/\/cms.zerohedge.com\/users\/tyler-durden\" class=\"username\">Tyler Durden<\/a><\/span><br \/>\n<span class=\"field field--name-created field--type-created field--label-hidden\">Wed, 12\/25\/2024 &#8211;
