{"id":1511480,"date":"2025-01-03T02:45:00","date_gmt":"2025-01-03T07:45:00","guid":{"rendered":"https:\/\/bugaluu.com\/news\/?p=1511480"},"modified":"2025-01-03T02:45:00","modified_gmt":"2025-01-03T07:45:00","slug":"trump-title-ix-2025-restore-real-learning-stop-fringe-sexual-politics","status":"publish","type":"post","link":"https:\/\/bugaluu.com\/news\/trump-title-ix-2025-restore-real-learning-stop-fringe-sexual-politics\/1511480\/","title":{"rendered":"Trump, Title IX, &amp; 2025: Restore Real Learning, Stop Fringe Sexual Politics"},"content":{"rendered":"<p><span class=\"field field--name-title field--type-string field--label-hidden\">Trump, Title IX, &amp; 2025: Restore Real Learning, Stop Fringe Sexual Politics<\/span><\/p>\n<div class=\"clearfix text-formatted field field--name-body field--type-text-with-summary field--label-hidden field__item\">\n<p><a href=\"https:\/\/amgreatness.com\/2025\/01\/02\/trump-title-ix-and-2025-restore-real-learning-stop-fringe-sexual-politics\/\"><em>Authored by Teresa Manning via American Greatness,<\/em><\/a><\/p>\n<p><em><strong>What can we expect from the Trump Administration on Title IX?<\/strong><\/em><\/p>\n<p>One hopes Trump will immediately undo the damage inflicted by Biden\u2019s Education Department, including rescission of the\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2024\/04\/29\/2024-07915\/nondiscrimination-on-the-basis-of-sex-in-education-programs-or-activities-receiving-federal\">Title IX rule issued in April<\/a>, already enjoined\u00a0<a href=\"https:\/\/amgreatness.com\/2024\/06\/21\/title-ix-victory-and-home-as-multiple-courts-rule-against-biden\/\">by federal courts<\/a>\u00a0in over half the country. The usual suspects will make the usual noise and claim Trump is \u201canti-woman\u201d and taking away rights, but<strong> if Trump focuses on\u00a0<a href=\"https:\/\/www.newsweek.com\/biden-admin-weaponizing-title-ix-promote-fringe-sexual-politics-opinion-1894635\">ending sexual identity politics<\/a>\u00a0to restore learning, he will be removing controversy and Title IX abuses, not causing them.<\/strong><\/p>\n<p><a href=\"https:\/\/cms.zerohedge.com\/s3\/files\/inline-images\/GettyImages-1414877372.jpg?itok=kcLoAwB0\"><\/a><\/p>\n<p><strong>Title IX is the 1972 Congressional ban on sex discrimination in federally funded education. <\/strong><\/p>\n<p>Called an equal access law for women, it was an outgrowth of equal opportunity initiatives based on race that were popular in the 1960s.<\/p>\n<p><strong>But Title IX soon became the\u00a0<a href=\"https:\/\/www.nas.org\/reports\/dear-colleague\">weapon<\/a>\u00a0of choice for feminists in government.<\/strong> They quickly interpreted it as requiring identical funding for female sports even when women weren\u2019t interested and even as this decimated men\u2019s teams. Then, they redefined \u201cdiscrimination\u201d to encompass \u201charassment\u201d and \u201ca hostile environment,\u201d still nebulous terms that many define as subjective offenses, which are anybody\u2019s guess, as the offense changes with the subject. This also makes healthy courtship a minefield since any romantic gesture, such as holding open a door, can offend\u00a0<em>someone\u00a0<\/em>and become a Title IX complaint. Then they expanded \u201charassment\u201d to include alleged sexual assault, a matter of criminal law at the state level, not civil rights law from Congress. But that didn\u2019t stop Obama education officials from directing campus Title IX offices to seek, find, and punish anyone merely accused of sexual misconduct by presuming guilt\u2014an egregious violation of due process. Hundreds of students were suspended or expelled by what were then called campus kangaroo courts.<\/p>\n<p>Biden officials continued this abuse of Title IX by\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2024\/04\/29\/2024-07915\/nondiscrimination-on-the-basis-of-sex-in-education-programs-or-activities-receiving-federal\">redefining<\/a>\u00a0the law\u2019s central term \u201csex\u201d to include same-sex orientation and \u201cgender ideology\u201d such that homosexuals and men pretending to be women (especially on women\u2019s sports teams) could claim a Title IX violation when others did not approve or go along.<\/p>\n<p><strong>The silver lining in this radicalization has been the inevitable pushback.<\/strong> Regular citizens have now woken up and are fighting back. For example, Trump\u2019s Education Secretary Betsy DeVos\u00a0<a href=\"https:\/\/www.ed.gov\/sites\/ed\/files\/about\/offices\/list\/ocr\/letters\/colleague-title-ix-201709.pdf\">reversed<\/a>\u00a0the abuses of the Obama administration, stopping campus kangaroo courts by issuing\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2020\/05\/19\/2020-10512\/nondiscrimination-on-the-basis-of-sex-in-education-programs-or-activities-receiving-federal\">a formal Title IX rule<\/a>\u00a0that protected due process for the accused but also mandated support for any accuser. The DeVos rule received an unprecedented 125,000 public comments during the rulemaking process\u2014most positive\u2014showing widespread public support for ending Title IX due process nightmares. What\u2019s more, when the DeVos rule was challenged in court, it was upheld as lawful and fair by every judge to review it.<\/p>\n<p>But Biden targeted the DeVos rule out of the gate in 2021 and then devised its own regulation, which includes the redefinition of sex. Unlike the DeVos rule, however, when the Biden regulation was challenged in court,\u00a0<a href=\"https:\/\/www.saveservices.org\/2022-policy\/abolish-doe\/\">it was found unlawful and unconstitutional<\/a>\u00a0(as administrative overreach), findings affirmed by the\u00a0<a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/24a78_f2ah.pdf\">United States Supreme Court<\/a>\u00a0last August. As a result, it\u2019s been enjoined in 26 states but applies in the remaining 24 where no lawsuits were filed.<\/p>\n<p><strong>So America is now a Title IX patchwork, ready to be remedied by President Trump.<\/strong><\/p>\n<p>How?<\/p>\n<p>On Inauguration Day, Trump should announce his intention to re-issue the DeVos rule and rescind the Biden regulation, citing the many\u00a0<a href=\"https:\/\/www.saveservices.org\/2022-policy\/abolish-doe\/\">federal court opinions<\/a>\u00a0on the latter\u2019s unlawfulness. Trump\u2019s Justice Department should also file Statements of Interest in the pending cases, informing the courts that the Department won\u2019t be defending Biden\u2019s actions.<\/p>\n<p><strong>The Trump Education Department should also declare as null and void all Title IX Resolution Agreements between the Biden Education Department and individual schools.<\/strong><\/p>\n<p>Many of these agreements are of highly questionable legality, as they appear to be the result of politically motivated investigations and, worse, impose conditions not authorized by law. For example, California\u2019s\u00a0<a href=\"https:\/\/www.ed.gov\/sites\/ed\/files\/about\/offices\/list\/ocr\/docs\/investigations\/more\/09212010-b.pdf?utm_content=&amp;utm_medium=email&amp;utm_name=&amp;utm_source=govdelivery&amp;utm_term=\">Taft College<\/a>\u00a0was investigated for an alleged Title IX offense when faculty did not use female pronouns demanded by a male student who enrolled as a male. The faculty\u2019s refusal to use pronouns was never a Title IX offense. The college should therefore not have even been investigated.<\/p>\n<p>Worse, the resulting Resolution Agreement requires faculty to use these pronouns\u2014what is called compelled speech and is illegal\u2014as if Title IX required it, though Title IX does no such thing. Worse still, Biden officials knew this since they were in the process of issuing a rule that made this very change. In short, Biden officials fraudulently treated their ideological goals as law and\u00a0<a href=\"https:\/\/www.mindingthecampus.org\/2024\/01\/05\/title-ix-in-2024-confusion-contempt-of-court-congress\/\">imposed them on Taft College.<\/a><\/p>\n<p>School districts are also targeted and subjected to legally questionable agreements with ideologically driven and expensive terms. The forthcoming report on the Education Department by the National Association of Scholars titled\u00a0<em>Wasteland: The Education Department\u2019s Profligacy, Mediocrity and Radicalism<\/em>, describes numerous such agreements with onerous conditions unauthorized by law and yet treated as binding legal precedent by the Biden Education Department. For example, the Resolution Agreement with\u00a0<a href=\"https:\/\/ocrcas.ed.gov\/sites\/default\/files\/ocr-letters-and-agreements\/07115001-b.pdf\">the Rapid City Area Schools in South Dakota<\/a>\u00a0required the district to hire consultants and experts to \u201cexamine the root causes of discrimination\u201d and to hire Diversity Directors and Directors of \u201cPositive School Climate.\u201d<\/p>\n<p><strong>Trump should make sure that all this gets the ax.<\/strong><\/p>\n<p>All that said, America should not kid itself that radicalization and the imposition of\u00a0<a href=\"https:\/\/www.newsweek.com\/biden-admin-weaponizing-title-ix-promote-fringe-sexual-politics-opinion-1894635\">fringe sexual politics<\/a>\u00a0on schools are limited to Title IX. Unfortunately, sex (and race) identity politics are everywhere in American education. They lurk behind a myriad of buzzwords and phrases such as \u201cdiversity, equity, and inclusion\u201d (\u201cDEI\u201d), \u201cmarginalized communities,\u201d \u201cunderrepresented minorities,\u201d and so on. Student conduct codes feature these terms along with policies on discrimination and harassment, which are variously defined and changing every day. Teachers and school staff from politicized teachers\u2019 colleges have been fed this politicized content for years, and they feel entitled to impose it on students and unsuspecting families as part of their job.<\/p>\n<p>In fact, if academic assessments are any indication, they view it as their\u00a0<em>whole<\/em>\u00a0job. Last month, the \u201cTrends in International Math and Science Studies,\u201d or\u00a0<a href=\"https:\/\/www.nytimes.com\/2024\/12\/04\/us\/us-math-students-pandemic.html\">TIMSS survey<\/a>, was published, showing declines among American students in math and science, similar to\u00a0<a href=\"https:\/\/www.brookings.edu\/articles\/the-alarming-state-of-the-american-student-in-2022\/\">declines documented<\/a>\u00a0in other areas such as English, writing skills, and reading comprehension. It is not hyperbole to say that indoctrination has replaced education in most American schools.<\/p>\n<p><strong>Trump should therefore act with confidence and resolve to shut down Title IX ideologies to restore real learning and academic excellence.
