Madalina Vasiliu\/The Epoch Times<\/em><\/a><\/p>\n<p>The new, unsigned <a href=\"https:\/\/www.supremecourt.gov\/orders\/courtorders\/041925zr_c18e.pdf\">order<\/a> granting the emergency application was issued on Saturday at about 12:55 a.m. <strong>&#8211; with Justices Clarence Thomas and Samuel Alito dissenting<\/strong>. Alito\u2019s reasoning will be added to the court\u2019s file later, according to the order.<\/p>\n<p>\u201c<strong>The Government is directed not to remove any member of the putative class of detainees from the United States until further order of this Court,<\/strong>\u201d the order states.<\/p>\n<p>NEW: The ACLU has quickly asked SCOTUS to halt an upcoming slate of apparent Alien Enemies Act deportations. The emergency injunction request went up to Justice Samuel Alito. <a href=\"https:\/\/t.co\/EEZxaHrqbN\">pic.twitter.com\/EEZxaHrqbN<\/a><\/p>\n<p>\u2014 Kaelan Deese (@KaelanDC) <a href=\"https:\/\/twitter.com\/KaelanDC\/status\/1913347668148998260?ref_src=twsrc%5Etfw\">April 18, 2025<\/a><\/p>\n<p><strong>As <\/strong><em><a href=\"https:\/\/www.theepochtimes.com\/us\/supreme-court-blocks-deportation-of-alleged-venezuelan-gang-members-for-now-5844267\">The Epoch Times<\/a><\/em> continues<strong>; The order notes that a request to block the deportations is currently pending before the U.S. Court of Appeals for the Fifth Circuit.<\/strong> After the Fifth Circuit acts, Solicitor General D. John Sauer should file a response to the application with the Supreme Court as soon as possible, the order states.<\/p>\n<p><strong>The order was issued after the American Civil Liberties Union (ACLU) filed an emergency request on behalf of its Venezuelan clients late on April 18<\/strong> asking the Supreme Court to immediately block the Trump administration from deporting the clients.<\/p>\n<p>The emergency <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24A1007\/356063\/20250418172902261_2025.04.18%20AARP%20Application.pdf\">application<\/a> in A.A.R.P. and W.M.M. v. Trump, which challenges President Donald Trump\u2019s use of the Alien Enemies Act to deport illegal immigrants who are alleged or confirmed criminal gang members, was directed to Justice Samuel Alito.<\/p>\n<p>The ACLU is also seeking a temporary restraining order from the U.S. District Court in the District of Columbia, as well as a stay of removal order from the Fifth Circuit, according to the application.<\/p>\n<p>On March 14, President Donald Trump <a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/03\/20\/2025-04865\/invocation-of-the-alien-enemies-act-regarding-the-invasion-of-the-united-states-by-tren-de-aragua\">signed<\/a> Proclamation 10903, in which he officially declared that Tren de Aragua, a designated foreign terrorist organization, \u201cis perpetrating, attempting, and threatening an invasion or predatory incursion against the territory of the United States.\u201d<\/p>\n<p>The group is using mass illegal immigration to the United States to harm U.S. citizens, undermine public safety, and support the goal of the Venezuelan regime with which it is associated to destabilize \u201cdemocratic nations in the Americas, including the United States,\u201d the proclamation said.<\/p>\n<p>The president invoked the Alien Enemies Act to authorize<strong> the \u201cimmediate apprehension, detention, and removal\u201d <\/strong>of members of the group who are Venezuelan citizens 14 years of age or older and who are not U.S. citizens or lawful permanent residents of the United States.<\/p>\n<p>The application said the ACLU\u2019s clients are challenging the Trump administration\u2019s use of the federal statute to deport them. The clients \u201care in imminent and ongoing jeopardy of being removed from the United States without notice or an opportunity to be heard, in direct contravention of this Court\u2019s order in Trump v. J.G.G.\u201d<\/p>\n<p>\u201cMany individuals have already been loaded on to buses, presumably headed to the airport\u201d and are at risk of being sent to a prison in El Salvador, according to the application.<\/p>\n<p>On March 15, the Trump administration used the Alien Enemies Act to deport at least 137 Venezuelans to El Salvador, where they are now incarcerated \u201cpossibly for the rest of their lives\u201d at the Salvadoran Terrorism Confinement Center, which is \u201cone of the most notorious prisons in the world,\u201d the application said.<\/p>\n<p>The application alleged that many deported since March 15 were not members of Tren de Aragua.<\/p>\n<p>\u201cSuch false accusations are particularly devastating given the present Applicants\u2019 strong claims for relief under our immigration laws,\u201d the application said.<\/p>\n<p>In Trump v. J.G.G., the Supreme Court on April 7 <a href=\"https:\/\/www.theepochtimes.com\/us\/supreme-court-grants-trumps-request-to-halt-order-in-deportations-case-5835290\">granted<\/a> the president\u2019s request to pause a federal district judge\u2019s orders preventing his administration from using the Alien Enemies Act to deport suspected members of Tren de Aragua but determined that detainees must be given an opportunity to challenge their removal.<\/p>\n<p>\u201c<strong>We grant the application and vacate the [temporary restraining orders],<\/strong>\u201d the court said in a per curiam, or unsigned, <a href=\"https:\/\/www.supremecourt.gov\/opinions\/24pdf\/24a931_2c83.pdf\">opinion<\/a> in the case. The decision applied to two original restraining orders and an extension issued by Washington-based U.S. District Judge James Boasberg.<\/p>\n<p>The Supreme Court application came the day after U.S. District Judge James Wesley Hendrix of the Northern District of Texas <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txnd.402915\/gov.uscourts.txnd.402915.27.0_2.pdf\">denied<\/a> the ACLU clients\u2019 request for a temporary restraining order halting removal efforts.<\/p>\n<p>Although the would-be deportees told the court they \u201care at imminent risk of summary removal\u201d from the United States, the court asked the government \u201cwhether it would remove A.A.R.P. or W.M.M. pending resolution of their habeas petition,\u201d Hendrix wrote in his April 17 order.<\/p>\n<p>A habeas petition is a request for a court to review a person\u2019s detention or imprisonment. It can also be used to contest a criminal conviction.<\/p>\n<p>\u201cThe United States answered unequivocally, stating that \u2018the government does not presently expect to remove [the applicants] A.A.R.P. or W.M.M. under the [Alien Enemies Act] until after the pending habeas petition is resolved\u2019 and that \u2018if that changes, we will update the Court,\u2019\u201d the judge wrote.<\/p>\n<p><strong>This means the petitioners are not at \u201cimminent risk of summary removal, and they cannot show a substantial threat of irreparable harm,\u201d Hendrix wrote.<\/strong><\/p>\n<p><em>*\u00a0 *\u00a0 *<\/em><\/p>\n<p>Constitutional scholar Jonathan Turley <a href=\"https:\/\/jonathanturley.org\/2025\/04\/19\/the-supreme-court-halts-venezuelan-deportations-as-the-fourth-circuit-upholds-garcia-order\/\">suggested<\/a> that the Court acted appropriately&#8230;<\/p>\n<p>Justices Clarence Thomas and Samuel Alito dissented from the order. However, <strong>this is merely a hold on deportations pending further review<\/strong> of the\u00a0emergency appeal from the American Civil Liberties Union, which is challenging the use of\u00a0the Alien Enemies Act of 1798.<\/p>\n<p>This rarely used and highly controversial law stretches back to the Adams Administration. <strong>There are good-faith arguments on both sides of the case that the Court wants to consider<\/strong>.
