Screenshot via The Epoch Times\/DOD<\/em><\/a><\/p>\n<p>In a <a href=\"https:\/\/www.courtlistener.com\/docket\/70131455\/14\/adirim-v-us-central-intelligence-agency\/\">ruling<\/a> issued on May 9, U.S. District Judge Michael Nachmanoff found that <strong>Adirim had failed to demonstrate a likelihood of success on the merits of her claim that the CIA violated her constitutional rights.<\/strong> The decision clears the way for the agency to proceed with terminating Adirim\u2019s employment under a contract provision allowing dismissal with 30 days\u2019 notice.<\/p>\n<p>Adirim, a former senior Defense Department official who served as the CIA\u2019s director of global health services, alleged in court filings that s<strong>he became the target of a politically motivated campaign led by activist Ivan Raiklin.<\/strong> She claimed in her <a href=\"https:\/\/www.courtlistener.com\/docket\/70131455\/1\/adirim-v-us-central-intelligence-agency\/\">lawsuit<\/a> that <strong>Raiklin defamed her as a traitor and \u201carchitect\u201d of the Pentagon\u2019s COVID-19 vaccine mandate<\/strong> and that he enlisted fellow activist<strong> Laura Loomer <\/strong>to persuade President Donald Trump to intervene with the CIA to have her fired.<\/p>\n<p>Her lawsuit named the CIA, Raiklin, CIA Director John Ratcliffe, and the conservative nonprofit America\u2019s Future as defendants. It alleged due process violations, defamation, breach of contract, and a Privacy Act violation stemming from alleged leaks about her dismissal to Breitbart News.<\/p>\n<p>In a 25-page opposition <a href=\"https:\/\/www.courtlistener.com\/docket\/70131455\/9\/adirim-v-us-central-intelligence-agency\/\">brief<\/a> filed on May 6, Justice Department attorneys called Adirim\u2019s theory \u201cspeculative and unsupported,\u201d arguing that her theory relied on loosely drawn connections and unsubstantiated assumptions about political influence.<\/p>\n<p>\u201c<strong>Plaintiff pinpoints the blame not on the CIA, but on a non-governmental actor, Ivan Raiklin, whom she accuses of orchestrating her termination through a scheme of defamation and political influence,<\/strong>\u201d the attorneys wrote. \u201cBesides being farfetched\u2014and untrue\u2014Plaintiff\u2019s allegations do not actually amount to any viable claim against the Federal Defendants, let alone any claim that merits an injunction.\u201d<\/p>\n<p>The Department of Justice acknowledged Adirim\u2019s name appeared on Raiklin\u2019s so-called Deep State Target List but said this had no bearing on the CIA\u2019s decision.<\/p>\n<p>\u201c<strong>There is no reason other than the close timing of Ms. Loomer\u2019s White House visit and the CIA\u2019s communication of its termination decision to Plaintiff to suggest the two are linked,<\/strong>\u201d the filing reads.<\/p>\n<p>The CIA maintained that Adirim wasn\u2019t terminated over politics but because of \u201cmultiple complaints\u201d from CIA staff about her \u201cinappropriate and harassing\u201d conduct in the workplace.<\/p>\n<p>According to a <a href=\"https:\/\/www.courtlistener.com\/docket\/70131455\/9\/1\/adirim-v-us-central-intelligence-agency\/\">declaration<\/a> from the agency\u2019s deputy chief operating officer, senior leadership initiated a review of Adirim\u2019s behavior weeks before Loomer\u2019s reported White House visit and made the decision to terminate her independently.<\/p>\n<p>The political and legal controversy surrounding the military\u2019s COVID-19 vaccination mandate intensified just days before the court\u2019s ruling. On May 7, the Pentagon issued sweeping new <a href=\"https:\/\/www.defense.gov\/Portals\/1\/Spotlight\/2025\/Guidance_For_Federal_Policies\/Supplemental-Guidance-to-the-Military-Department-Discharge-Review-Boards-and-Boards-for-Correction-of-Military-Naval-Records.pdf\">guidance<\/a> acknowledging that the mandate had been \u201can unfair, overbroad, and completely unnecessary burden\u201d on servicemembers. The memo directed military review boards to reinstate troops discharged over the mandate and remove related disciplinary records, declaring that the lack of due process in enforcing vaccine compliance was itself \u201can injustice.\u201d<\/p>\n<p><strong>Adirim, who had signed key policy documents enabling the Pentagon\u2019s mandate while serving as acting assistant secretary of defense for health affairs, became a focal point in that broader political reckoning<\/strong>\u2014even as the CIA maintained her dismissal was unrelated.<\/p>\n<p><a href=\"https:\/\/assets.zerohedge.com\/s3fs-public\/inline-images\/image_92%2813%29_0.jpg?itok=oMoHCrUa\"><em>A soldier watches another soldier receive his COVID-19 vaccination from Army Preventative Medical Services in Fort Knox, Ky., on Sept. 9, 2021. Jon Cherry\/Getty Images<\/em><\/a><\/p>\n<p>In her complaint, Adirim contended that being fired just weeks before qualifying for federal retirement amounted to irreparable harm, that she had been defamed after decades of public service, and that her family had been endangered.<\/p>\n<p><strong>The CIA said the decision was internal, lawful, and based on employee complaints rather than political pressure.<\/strong><\/p>\n<p>In response to the May 9 ruling, Adirim\u2019s attorney Kevin Carroll told The Epoch Times in an emailed statement, \u201cWe respect the court\u2019s decision and look forward to litigating the underlying issues.\u201d<\/p>\n<p>The case remains active in federal court but, without the injunction she had sought, Adirim\u2019s termination is now set to proceed as planned.<\/p>\n<p>Raiklin, in a <a href=\"https:\/\/x.com\/IvanRaiklin\/status\/1920992347770249599\">post<\/a> on social media platform X, hailed the decision: \u201cTerry Adirim, you\u2019re fired!!!
