{"id":1539149,"date":"2025-05-31T16:50:00","date_gmt":"2025-05-31T20:50:00","guid":{"rendered":"https:\/\/bugaluu.com\/news\/?p=1539149"},"modified":"2025-05-31T16:50:00","modified_gmt":"2025-05-31T20:50:00","slug":"appeals-court-blocks-trump-admins-push-for-mass-federal-firings","status":"publish","type":"post","link":"https:\/\/bugaluu.com\/news\/appeals-court-blocks-trump-admins-push-for-mass-federal-firings\/1539149\/","title":{"rendered":"Appeals Court Blocks Trump Admin&#8217;s Push For Mass Federal Firings"},"content":{"rendered":"<p><span class=\"field field--name-title field--type-string field--label-hidden\">Appeals Court Blocks Trump Admin&#8217;s Push For Mass Federal Firings<\/span><\/p>\n<div class=\"clearfix text-formatted field field--name-body field--type-text-with-summary field--label-hidden field__item\">\n<p><a href=\"https:\/\/www.theepochtimes.com\/us\/appeals-court-denies-trump-admins-bid-to-stay-order-blocking-mass-firings-of-federal-workers-5865916?utm_source=partner&amp;utm_campaign=ZeroHedge\"><em>Authored by Aldgra Fredly via The Epoch Times,<\/em><\/a><\/p>\n<p>A San Francisco-based federal appeals court on Friday denied the Trump administration\u2019s bid to pause a lower court ruling that had blocked President Donald Trump\u2019s directives for workforce reductions at federal agencies from taking effect.<\/p>\n<p><a href=\"https:\/\/cms.zerohedge.com\/s3\/files\/inline-images\/image%20-%202025-05-31T071555.665.jpg?itok=uZxj6Jue\"><\/a><\/p>\n<p><strong>In a 2-1 decision, the Ninth Circuit Court of Appeals ruled\u2014with one judge dissenting\u2014that Trump\u2019s executive order directing agency leaders to carry out mass firings \u201cfar exceeds the president\u2019s supervisory powers under the Constitution.\u201d<\/strong><\/p>\n<p>Circuit Judge William Fletcher <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ca9.a1f27711-b6ee-4afd-b435-49b4d91a8d5c\/gov.uscourts.ca9.a1f27711-b6ee-4afd-b435-49b4d91a8d5c.10.0.pdf\">stated<\/a> that the administration has \u201cnot identified a federal statute\u201d granting the authority to conduct large-scale workforce reductions, and that the reorganization plans outlined in Trump\u2019s order have \u201clong been subject to Congressional approval.\u201d<\/p>\n<p>In her dissent, Circuit Judge Consuelo M. Callahan stated that <strong>federal agencies have statutory authority to lay off staff, which \u201ccontemplates that agency [reductions in force] may affect a significant number of employees.\u201d<\/strong><\/p>\n<p>Callahan said that Trump\u2019s order aimed to advance his \u201cpolicy objective of reducing the size of the federal government\u201d by directing agencies to initiate large-scale workforce reductions and to target departments that \u201cperform functions not mandated by statute or other law.\u201d<\/p>\n<p><strong>The court\u2019s decision follows U.S. District Judge Susan Illston\u2019s temporary restraining order on May 9 that blocked the implementation of Trump\u2019s order for two weeks.<\/strong> Illson <a href=\"https:\/\/www.theepochtimes.com\/us\/judge-temporarily-blocks-trump-admins-mass-firings-of-federal-workers-5855508\">determined<\/a> that Trump overstepped his authority by issuing an order for large-scale reductions in force across agencies without getting congressional approval.<\/p>\n<p>The judge said the Office of Personnel Management (OPM), the Office of Management and Budget (OMB), and the Department of Government Efficiency (DOGE) do not have statutory power to direct other federal agencies to conduct large-scale staff terminations and restructuring.<\/p>\n<p><strong>The order applies to multiple federal agencies,<\/strong> including the departments of Agriculture, Commerce, Defense, Energy, Health and Human Services, Homeland Security, Housing and Urban Development, Interior, Labor, Transportation, Treasury, and Veterans Affairs.<\/p>\n<p>Plaintiffs in the lawsuit include the American Federation of Government Employees, Alliance for Retired Americans, American Public Health Association, Center for Taxpayer Rights, and the cities and counties in California, Illinois, Maryland, Texas, and Washington.<\/p>\n<p>The coalition said in a <a href=\"https:\/\/democracyforward.org\/updates\/omnibus-rif-pi-050925\/\">statement<\/a> released by Democracy Forward, the nonprofit legal organization representing the plaintiffs, on May 9 that the administration\u2019s actions would disrupt critical services.<\/p>\n<p><strong>Since the start of the Trump administration on Jan. 20, thousands of government employees have been laid off across multiple <a href=\"https:\/\/www.theepochtimes.com\/us\/trump-administration-fires-thousands-of-government-workers-5811408\">agencies<\/a>, while others have opted to leave under a buyout program offered by the administration, <\/strong>amid ongoing cost-cutting efforts by DOGE, which has been tasked by Trump to identify and eliminate fraud and waste within the federal government.<\/p>\n<p>The Epoch Times has reached out to the White House for comment and did not receive a response by publication time.<\/p>\n<\/div>\n<p>      <span class=\"field field--name-uid field--type-entity-reference field--label-hidden\"><a title=\"View user profile.\" href=\"https:\/\/cms.zerohedge.com\/users\/tyler-durden\" class=\"username\">Tyler Durden<\/a><\/span><br \/>\n<span class=\"field field--name-created field--type-created field--label-hidden\">Sat, 05\/31\/2025 &#8211;
