California Risks Federal Actions Over Transgender Athletes On Women’s Sports<\/span><\/p>\n

The U.S. Department of Education has found California in violation of federal anti-discrimination laws for allowing male athletes to compete in women\u2019s sports.<\/strong><\/p>\n

<\/a><\/p>\n

The finding<\/a> on June 25 follows investigations launched earlier this year into both the California Interscholastic Federation (CIF), which is the governing body for high school sports in the state, and the California Department of Education.<\/p>\n

The inquiries, opened in February and April, focused on whether California\u2019s School Success and Opportunity Act conflicts with Title IX, the law prohibiting sex-based discrimination in education programs that receive federal dollars.<\/p>\n

The California law, in effect since 2014, allows students to participate in sports programs and use sex-segregated bathrooms and locker rooms based on their preferred gender identity rather than biological sex.<\/p>\n

CIF has stated<\/a> that it intends to continue following state law, even as President Donald Trump warned<\/a> that doing so could jeopardize its federal funding.<\/p>\n

As a result of Wednesday\u2019s noncompliance finding, the U.S. Education Department outlined a series of required actions that state authorities must implement within 10 days.<\/strong><\/p>\n

Those include directing schools to adopt biology-based definitions of \u201cmale\u201d and \u201cfemale\u201d; restoring titles, awards, and records to female athletes who were displaced by male competitors in girls\u2019 events; and sending personalized letters of apology to each affected female athlete on behalf of California for the discrimination they had suffered.<\/p>\n

Failure to comply, the U.S. Education Department warned, could be met with enforcement actions, including referral to the U.S. Department of Justice for legal proceedings.<\/strong><\/p>\n

The state agencies did not immediately respond to requests for comment.<\/p>\n

The announcement comes just weeks after CIF crowned<\/a> two champions in girls\u2019 track and field events at the state meet, where a transgender athlete took first place in both the high jump and triple jump. The male student, who also finished second in the long jump, shared the podium with female competitors under a new rule that allows all athletes to receive medals based on their placement if no transgender athlete had competed.<\/p>\n

\u201cThe CIF values all of our student-athletes and we will continue to uphold our mission of providing students with the opportunity to belong, connect, and compete while complying with California law and Education Code,\u201d the federation said<\/a> in a statement ahead of the championship matches.<\/p>\n

In March, in a rare change of tone, California Gov. Gavin Newsom, a Democrat, described<\/a> the current policy as \u201cdeeply unfair\u201d during an episode of his own podcast. Speaking with conservative commentator Charlie Kirk, Newsom agreed with Kirk\u2019s argument that Democrats had become out of touch with many Americans by insisting that transgender athletes should compete based on gender identity.<\/p>\n

\u201cI revere sports, and so the issue of fairness is completely legit,\u201d <\/strong><\/em>Newsom told Kirk. He has not yet proposed any changes to the law since the show aired and has drawn criticism<\/a> from members of the Democratic Party, including pro-LGBT state lawmakers.<\/p>\n

Citing the governor\u2019s remarks, U.S. Education Secretary Linda McMahon condemned the state\u2019s continued enforcement of the policy.<\/p>\n

\u201cAlthough Governor Gavin Newsom admitted months ago it was \u2018deeply unfair\u2019 to allow men to compete in women\u2019s sports, both the California Department of Education and the California Interscholastic Federation continued as recently as a few weeks ago to allow men to steal female athletes\u2019 well-deserved accolades and to subject them to the indignity of unfair and unsafe competitions,\u201d<\/strong><\/em> McMahon said in a statement.<\/p>\n

\u201cThe Trump Administration will relentlessly enforce Title IX protections for women and girls, and our findings today make clear that California has failed to adhere to its obligations under federal law.<\/em><\/p>\n

\u201cThe state must swiftly come into compliance with Title IX or face the consequences that follow.\u201d<\/strong><\/em><\/p>\n<\/div>\n
