Justin Sullivan\/Getty Images<\/em><\/a><\/p>\n<p>In a statement posted on LinkedIn, <strong>Kaplan <a href=\"https:\/\/www.linkedin.com\/posts\/joel-kaplan-63905618_europe-is-heading-down-the-wrong-path-on-activity-7351928745668055042-XuF7?utm_source=share&amp;utm_medium=member_desktop&amp;rcm=ACoAAAb3xYkBQRmmhWtlRn1Hewtui4obu7xUImU\">said<\/a> the company will not be signing the Code of Practice for General-Purpose AI (GPAI), a set of nonbinding <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/contents-code-gpai\">guidelines<\/a> covering AI transparency, copyright, and security.<\/strong><\/p>\n<p>Designed for developers of general-purpose AI models, the code aims to help them prepare for, and comply with, the <a href=\"https:\/\/www.europarl.europa.eu\/topics\/en\/article\/20230601STO93804\/eu-ai-act-first-regulation-on-artificial-intelligence\">AI Act<\/a>, which takes effect in stages starting Aug. 2.<\/p>\n<p>\u201c<strong>Europe is heading down the wrong path on AI,<\/strong>\u201d Kaplan said. \u201cWe have carefully reviewed the European Commission\u2019s Code of Practice for general-purpose AI models and Meta won\u2019t be signing it. This Code introduces a number of legal uncertainties for model developers, as well as measures which go far beyond the scope of the AI Act.\u201d<\/p>\n<p>The EU\u2019s AI Act creates one system for all EU countries, dividing AI into four risk levels: unacceptable, high, limited, and minimal. High-risk systems, like those in critical infrastructure or hiring, face strict requirements, including safety checks and documentation.<\/p>\n<p>It covers the regulation of large language models and foundation models built by companies such as Meta\u2019s Llama, OpenAI\u2019s GPT-4, Google DeepMind\u2019s Gemini, and Anthropic\u2019s Claude.<\/p>\n<p><strong>Companies failing to comply could face fines <a href=\"https:\/\/www.reuters.com\/world\/europe\/eu-countries-back-landmark-artificial-intelligence-rules-2024-05-21\/\">ranging<\/a> from 7.5 million euros ($8.7 million) or 1.5 percent of turnover<\/strong>, to as much as 35 million euros ($38.2 million) or 7 percent of global turnover.<\/p>\n<h2>Businesses Voice Concerns<\/h2>\n<p>The release of the GPAI Code was delayed several times before the European Commission published the final version on July 10.<\/p>\n<p>The EU <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/contents-code-gpai\">said<\/a> companies that voluntarily sign the GPAI will face a lighter administrative burden and gain more legal certainty compared to proving compliance through other methods. Last week, ChatGPT-maker\u00a0<a href=\"https:\/\/openai.com\/global-affairs\/eu-code-of-practice\/\">OpenAI<\/a> announced its intention to sign the code.<\/p>\n<p>Kaplan pointed to industry uncertainty over the EU\u2019s AI regulation, <strong>citing concerns by 44 of Europe\u2019s largest companies<\/strong>, including Bosch, Siemens, SAP, Lufthansa, Airbus, and BNP.<\/p>\n<p>In an open <a href=\"https:\/\/aichampions.eu\/#supporters\">letter<\/a>, dozens of top European business leaders earlier this month urged EU officials to postpone key parts of the AI Act by two years, warning that the current rules are too complex and risk undermining Europe\u2019s competitiveness in artificial intelligence.<\/p>\n<p>The group said the AI Act, set to impose new obligations on both high-risk AI systems and general-purpose AI models starting in 2025 and 2026, could stifle innovation if implemented too quickly.<\/p>\n<p>\u201cWe share concerns raised by these businesses that this over-reach will throttle the development and deployment of frontier AI models in Europe, and stunt European companies looking to build businesses on top of them,\u201d Kaplan said.<\/p>\n<h2>New Guidelines<\/h2>\n<p>Meta\u2019s announcement came on the same day the European Commission <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/news\/commission-publishes-guidelines-providers-general-purpose-ai-models#:~:text=Henna%20Virkkunen%2C%20Executive%20Vice-President,application%20of%20the%20AI%20Act.\">published<\/a> new guidelines explaining how general-purpose AI companies must comply with the EU\u2019s AI Act.<\/p>\n<p><strong>The guidelines list several key requirements, including writing clear technical documentation, explaining what data was used to train the models, setting copyright policies, and protecting AI systems from misuse or hacking.<\/strong><\/p>\n<p>For the most advanced AI models that could pose risks to public safety, human rights, or society, developers will also need to run safety tests, reduce potential harms, and report serious incidents to EU regulators.<\/p>\n<p>\u201cBy providing legal certainty on the scope of the AI Act obligations for general-purpose AI providers, we are helping AI actors, from start-ups to major developers, to innovate with confidence, while ensuring their models are safe, transparent, and aligned with European values,\u201d the EU\u2019s executive vice-president for tech sovereignty, security, and democracy, Henna Virkkunen, <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/news\/commission-publishes-guidelines-providers-general-purpose-ai-models#:~:text=Henna%20Virkkunen%2C%20Executive%20Vice-President,application%20of%20the%20AI%20Act.\">said<\/a> in a statement.<\/p>\n<p>To support innovation, the commission <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/faqs\/guidelines-obligations-general-purpose-ai-providers\">said<\/a> companies making significant modifications to existing models will only need to document the changes and the new training data used, rather than provide full documentation of the entire model.<\/p>\n<p>Officials said this approach is designed to enable most developers to build on existing models without facing excessive regulation.<\/p>\n<\/div>\n<p>      <span class=\"field field--name-uid field--type-entity-reference field--label-hidden\"><a title=\"View user profile.\" href=\"https:\/\/cms.zerohedge.com\/users\/tyler-durden\" class=\"username\">Tyler Durden<\/a><\/span><br \/>\n<span class=\"field field--name-created field--type-created field--label-hidden\">Sat, 07\/19\/2025 &#8211;
