Philip Murphy <a href=\"https:\/\/www.nj.gov\/governor\/news\/news\/562021\/20210820a.shtml\">signed<\/a> into law Assembly Bill 5207, which <a href=\"https:\/\/legiscan.com\/NJ\/bill\/A5207\/2020\">bans<\/a> state and local entities, as well as private detention facilities, from entering into agreements to detain illegal immigrants<\/strong>. In February 2023, CoreCivic, which operates private correctional and detention facilities across the United States, <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.njd.508652\/gov.uscourts.njd.508652.1.0.pdf\">sued<\/a> New Jersey officials, including Murphy.<\/p>\n<p>AB 5207 prohibits CoreCivic from renewing a contract with ICE under which the company manages and operates the Elizabeth Detention Center in Elizabeth, New Jersey, which represents \u201cessentially the entire immigration detention capacity for the Federal Government in New Jersey,\u201d the lawsuit said.<\/p>\n<p>The complaint argued that AB 5207 \u201cundermines and eliminates the congressionally funded and approved enforcement of federal immigration law by U.S. Immigration and Customs Enforcement (ICE) within the State of New Jersey.\u201d<\/p>\n<p>In a July 22 ruling, the Third Circuit appeals court sided with CoreCivic.<\/p>\n<p>\u201c<strong>Just as the federal government cannot control a state, so too a state cannot control the federal government. Each is sovereign. Each is \u2018protected from incursion by the other<\/strong>,\u2019\u201d Circuit Judge Stephanos Bibas wrote.<\/p>\n<p>Sometimes, a state interferes directly with federal policy, destroying it through \u201chostile legislation,\u201d he added.<\/p>\n<p>\u201cAnd when it crosses that line, it violates the Constitution. New Jersey is on the wrong side of that line. It dislikes some of the federal government\u2019s immigration tools, so it passed a law with the \u2018intent\u2019 to forbid new contracts for civil immigration detention,\u201d Bibas stated.<\/p>\n<p>\u201c<strong>Because New Jersey\u2019s law violates intergovernmental immunity, we will affirm the District Court\u2019s summary judgment for the contractor<\/strong>.\u201d<\/p>\n<p>The summary <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.njd.508652\/gov.uscourts.njd.508652.50.0.pdf\">judgment<\/a> had favored CoreCivic and declared AB 5207 \u201cunconstitutional.\u201d<\/p>\n<p>Bibas was joined by Circuit Judge Cheryl Ann Krause.<\/p>\n<p>Circuit Judge Thomas Ambro said in a dissent that New Jersey\u2019s law only directly regulates the state, local governments, and private companies.<\/p>\n<p>Sen. Cory Booker (D-N.J.) criticized the appeals court decision, calling it a moral failure, in a July 22 <a href=\"https:\/\/www.booker.senate.gov\/news\/press\/booker-blasts-third-circuit-court-of-appeals-decision-on-ab5207-moral-failing\">statement<\/a> from the lawmaker\u2019s office.<\/p>\n<p>The ruling from the appeals court \u201callows private prisons to profit from immigrant detention contracts, hindering the state legislature\u2019s power to protect New Jerseyans from predatory, greedy, and abusive private prison companies,\u201d he said.<\/p>\n<p>\u201c<strong>This decision perpetuates a perverse incentive to fill beds that put corporate profits over human costs and undermines the will of New Jerseyans whose democratically-elected officials passed this legislation.<\/strong>\u201d<\/p>\n<p>On its website, CoreCivic <a href=\"https:\/\/www.corecivic.com\/private-detention\">states<\/a> that it plays a \u201climited but important role\u201d in the country\u2019s immigration system.<\/p>\n<p>The company says its facilities are contractually obligated to adhere to rigorous federal immigration standards, adding that the sites routinely get independently audited without any prior notice.<\/p>\n<p>Without private contractors, there will be a \u201cmajor hole\u201d in the country\u2019s immigration system with billions of dollars in taxpayer funds funneled to build new detention facilities and hire public employees, the company states.<\/p>\n<p><strong>CoreCivic treats the people held at its facilities humanely while they prepare for their immigration procedures, according to its website.<\/strong><\/p>\n<p>The Epoch Times reached out to CoreCivic and Murphy for comment but did not receive a response by publication time.<\/p>\n<p>The Trump administration is pushing ahead with its policies addressing illegal immigration.<\/p>\n<p>In a July 23 X <a href=\"https:\/\/x.com\/WhiteHouse\/status\/1947774998346666059\">post<\/a>, the White House said that ICE arrests of criminal illegal immigrants across various states have soared under the Trump administration.<\/p>\n<p>\u201cPresident Donald J.
