Rory Doyle\/AFP via Getty Images<\/em><\/a><\/p>\n<p>Mississippi\u2019s House Bill 1193 became <a href=\"https:\/\/mdek12.org\/wp-content\/uploads\/sites\/29\/2025\/05\/Tab-02-OSS-OAC-HB1193-DEI-Policy-board-item.-05.15.25.pdf\">effective<\/a> on April 17. The law prohibits DEI activities in public schools and public postsecondary educational institutions. It bans the establishment of DEI offices, engagement in divisive concepts, consideration of diversity statements from job applicants as part of hiring, and maintenance of academic programs promoting ideologies such as DEI and transgenderism.<\/p>\n<p>On June 9, a coalition of plaintiffs, including the Mississippi Association of Educators, <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mssd.129475\/gov.uscourts.mssd.129475.1.0_1.pdf\">sued<\/a> state boards over the implementation of HB 1193. <strong>They argued that the law contained \u201cviewpoint-based and content-based restrictions.\u201d<\/strong><\/p>\n<p>The bill violates the First and 14th amendments rights of educators and students, the complaint said.<\/p>\n<p>On July 20, the federal court sided with the plaintiffs by granting a request for a temporary restraining order (TRO), which directs the state of Mississippi and defendants in the case from enforcing <a href=\"https:\/\/billstatus.ls.state.ms.us\/documents\/2025\/html\/HB\/1100-1199\/HB1193SG.htm\">provisions<\/a> of HB 1193 pending further court order.<\/p>\n<p><strong>The TRO will remain in effect until the court issues a ruling on the plaintiffs\u2019 request for a permanent injunction.<\/strong> A hearing on the injunction has been scheduled for July 23.<\/p>\n<p>In an earlier <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mssd.129475\/gov.uscourts.mssd.129475.18.0.pdf\">motion<\/a> filed with the court on June 23, state officials had asked the court to dismiss the lawsuit, arguing that the complaint is \u201cbarred by Eleventh Amendment sovereign immunity.\u201d<\/p>\n<p>The defendants in the case are the Board of Trustees of State Institutions of Higher Learning, the Mississippi Community College Board, the Mississippi State Board of Education, and the Mississippi Charter School Authorizer Board.<\/p>\n<p>All defendants are state boards that are \u201carms\u201d of the state of Mississippi, according to the motion, which said, \u201c<strong>It is well settled that the State\u2019s Eleventh Amendment sovereign immunity extends to any state agency or entity deemed an \u2018arm\u2019 of the State.\u201d<\/strong><\/p>\n<p>On Jan. 21, President Donald Trump <a href=\"https:\/\/www.theepochtimes.com\/us\/trump-orders-schools-colleges-to-end-dei-or-lose-federal-funding-5797183\">signed<\/a> an executive action \u201cEnding Illegal Discrimination and Restoring Merit-Based Opportunity.\u201d<\/p>\n<p>According to the order, any school that doesn\u2019t end its DEI programs will lose federal funding.<\/p>\n<p><strong>On April 23, Trump signed an executive <a href=\"https:\/\/www.theepochtimes.com\/us\/trump-signs-spate-of-orders-targeting-education-5846598\">order<\/a> to end DEI in the accreditation of colleges and universities.<\/strong><\/p>\n<p>\u201cThe existing accreditation monopoly raises costs, contributes to the ever-increasing tuition and fees faced by American families, favors legacy four-year institutions, blocks new accreditors from the market, interferes with states\u2019 governing board decisions, and pushes universities in ideological directions when they should be focused on core subjects,\u201d Education Secretary Linda McMahon said in a statement at the time.<\/p>\n<p>\u201cThe result is more bureaucracy, less innovation, sprawling DEI administrative complexes, and burdensome oversight by unaccountable accreditors rather than state education leaders and duly appointed governing board members.\u201d<\/p>\n<p>At the state level, Arkansas recently notched a legal win when the Court of Appeals for the Eighth Circuit <a href=\"https:\/\/www.theepochtimes.com\/us\/arkansas-can-enforce-critical-race-theory-ban-in-classrooms-appeals-court-rules-5888929\">issued<\/a> a ruling on July 16 allowing the state to enforce its ban on critical race theory in the state\u2019s public schools.<\/p>\n<\/div>\n<p>      <span class=\"field field--name-uid field--type-entity-reference field--label-hidden\"><a title=\"View user profile.\" href=\"https:\/\/cms.zerohedge.com\/users\/tyler-durden\" class=\"username\">Tyler Durden<\/a><\/span><br \/>\n<span class=\"field field--name-created field--type-created field--label-hidden\">Wed, 07\/23\/2025 &#8211;
