{"id":1666509,"date":"2026-02-26T00:15:00","date_gmt":"2026-02-26T05:15:00","guid":{"rendered":"https:\/\/bugaluu.com\/news\/?p=1666509"},"modified":"2026-02-26T00:15:00","modified_gmt":"2026-02-26T05:15:00","slug":"college-cannot-force-ca-professor-to-embed-dei-practices-in-classroom-judge-rules-2","status":"publish","type":"post","link":"https:\/\/bugaluu.com\/news\/college-cannot-force-ca-professor-to-embed-dei-practices-in-classroom-judge-rules-2\/1666509\/","title":{"rendered":"College Cannot Force CA Professor To Embed DEI Practices In Classroom, Judge Rules"},"content":{"rendered":"<p><span class=\"field field--name-title field--type-string field--label-hidden\">College Cannot Force CA Professor To Embed DEI Practices In Classroom, Judge Rules<\/span><\/p>\n<div class=\"clearfix text-formatted field field--name-body field--type-text-with-summary field--label-hidden field__item\">\n<p><a href=\"https:\/\/www.thecollegefix.com\/college-cannot-force-calif-professor-to-embed-dei-practices-in-classroom-judge-rules\/\"><em>Authored by Jennifer Kabbany via The College Fix,<\/em><\/a><\/p>\n<p>A California community college <strong>professor cannot be required to embed diversity, equity, inclusion and accessibility practices in his classroom,<\/strong> a federal judge has ruled.<\/p>\n<p><a href=\"https:\/\/cms.zerohedge.com\/s3\/files\/inline-images\/DaymonJohnson72-1-560x367.jpg?itok=3P2z76FS\"><\/a><\/p>\n<p><strong>The decision is the latest development in a nearly\u00a0<a href=\"https:\/\/www.thecollegefix.com\/professor-sues-college-after-being-investigated-for-calling-peer-social-justice-warrior-on-social-media\/\">three-year-old lawsuit<\/a>\u00a0filed by Daymon Johnson,<\/strong> a history professor at Bakersfield College, part of the Kern Community College District.<\/p>\n<p>Johnson is also\u00a0<a href=\"https:\/\/www.bakersfieldcollege.edu\/community\/renegade-institute-for-liberty\/index.html\">faculty lead<\/a>\u00a0of the Renegade Institute for Liberty.<\/p>\n<p>Two California Code of Regulations provisions would require Johnson to employ teaching, learning, and professional practices reflecting diversity, equity, inclusion and accessibility, or DEIA, as well as mandate the professor establish proficiency in DEI to teach or lead within California\u2019s community colleges, the decision states.<\/p>\n<p>But a faculty institute that Johnson leads does not conform to DEI concepts, as it is \u201cdedicated to the pursuit of free speech, open inquiry, critical thinking to advance American ideals within the broader Western tradition of meritocracy, individual agency, civic virtue, liberty of conscience and free markets,\u201d its website states.<\/p>\n<p><em><strong>\u201cJohnson alleges that the DEIA regulations compel his speech and discriminate against his viewpoint in violation of the First Amendment,\u201d\u00a0 <\/strong>wrote U.S. District Judge Kirk Sherriff.<\/em><\/p>\n<p><em>\u201cHe alleges that he fears either being compelled to express a viewpoint with which he disagrees or being punished if he continues to refuse to express defendants\u2019 desired viewpoint or if he expresses his contrary views,\u201d the judge wrote.\u00a0<\/em><\/p>\n<p><strong>Judge Sheriff agreed with that concern, and granted on Feb. 20 Johnson\u2019s motion for a preliminary injunction that blocks college leaders from &#8220;investigating, disciplining, or terminating the history professor based on any of his speech in the classroom, his scholarship, or as a private citizen,\u201d<\/strong> the scholar\u2019s attorneys\u00a0<a href=\"https:\/\/www.ifs.org\/news\/federal-court-blocks-enforcement-of-californias-mandatory-deia-and-anti-racist-ideology-against-bakersfield-college-professor\/\">stated<\/a>\u00a0in a Feb. 23 news release.<\/p>\n<p>Sheriff\u2019s 27-page\u00a0<a href=\"https:\/\/www.ifs.org\/wp-content\/uploads\/2026\/02\/Johnson-Order.pdf\">ruling<\/a>\u00a0stated: \u201cJohnson has credibly identified specific speech that he reasonably fears would be proscribed by the DEIA regulations. And as the Ninth Circuit has found, he \u2018has established a \u2018concrete plan to violate the law\u2019 based on his allegations regarding his desired speech and his refusal to express support for [DEIA] principles.&#8217;\u201d<\/p>\n<p><strong>The Ninth Circuit in July 2025 had\u00a0<a href=\"https:\/\/www.thecollegefix.com\/calif-professor-can-continue-free-speech-battle-against-dei-ninth-circuit-rules\/\">ruled<\/a>\u00a0Johnson could continue his lawsuit over the college district\u2019s objections.<\/strong><\/p>\n<p><em>\u201cThe First Amendment forbids California from demanding that community college professors conform their speech to an official government ideology\u2014including so-called \u2018DEI\u2019 and anti-racist ideologies,\u201d\u00a0<a href=\"https:\/\/www.ifs.org\/news\/federal-court-blocks-enforcement-of-californias-mandatory-deia-and-anti-racist-ideology-against-bakersfield-college-professor\/\">said<\/a>\u00a0Institute for Free Speech Vice President for Litigation Alan Gura, lead counsel for Johnson, in a news release.<\/em><\/p>\n<p><strong>However, the judge did rule district leaders can require Johnson take mandatory DEI training as a requirement to participate on faculty screening committees,\u00a0<\/strong><em>Courthouse News Service<\/em>\u00a0<a href=\"https:\/\/www.courthousenews.com\/bakersfield-college-cant-fire-professor-for-anti-dei-beliefs\/\">reported<\/a>.<\/p>\n<p>Kern Community College District leaders did not respond to an email from\u00a0<em>The College Fix<\/em>\u00a0on Tuesday requesting comment on the decision.<\/p>\n<p><em><strong>\u201cThe ruling is temporary, since it came in the form of a preliminary injunction, meaning the case is active and can still proceed to trial,\u201d\u00a0<\/strong>Courthouse News<\/em>\u00a0reported.<\/p>\n<p>Reached for comment, a Kern district spokesperson told\u00a0<em>The Fix<\/em>\u00a0officials have received the court\u2019s ruling regarding the motion for a preliminary injunction in the Johnson case.\u00a0<\/p>\n<p><em>\u201cOur focus remains on ensuring a stable and productive environment for our entire campus community.
