{"id":1666607,"date":"2026-02-26T16:40:00","date_gmt":"2026-02-26T21:40:00","guid":{"rendered":"https:\/\/bugaluu.com\/news\/?p=1666607"},"modified":"2026-02-26T16:40:00","modified_gmt":"2026-02-26T21:40:00","slug":"biden-appointed-judge-rules-illegal-immigrants-can-dispute-third-country-deportations","status":"publish","type":"post","link":"https:\/\/bugaluu.com\/news\/biden-appointed-judge-rules-illegal-immigrants-can-dispute-third-country-deportations\/1666607\/","title":{"rendered":"Biden-Appointed Judge Rules Illegal Immigrants Can Dispute Third Country Deportations"},"content":{"rendered":"<p><span class=\"field field--name-title field--type-string field--label-hidden\">Biden-Appointed Judge Rules Illegal Immigrants Can Dispute Third Country Deportations<\/span><\/p>\n<div class=\"clearfix text-formatted field field--name-body field--type-text-with-summary field--label-hidden field__item\">\n<p><a href=\"https:\/\/www.theepochtimes.com\/us\/judge-rules-illegal-immigrants-can-dispute-third-country-deportations-5990946?utm_source=partner&amp;utm_campaign=ZeroHedge\"><em>Authored by Stacy Robinson via The Epoch Times,<\/em><\/a><\/p>\n<p><strong>A federal judge ruled on Feb. 25 that the government cannot deport illegal immigrants to so-called third countries without giving them \u201cmeaningful notice\u201d and an opportunity to dispute their removal.<\/strong><\/p>\n<p><a href=\"https:\/\/cms.zerohedge.com\/s3\/files\/inline-images\/image%20%2880%29_7.jpg?itok=Gvh7Ttos\"><\/a><\/p>\n<p>In Wednesday\u2019s ruling, Massachusetts District Judge Brian Murphy (<em><strong>nominated by President Biden on March 21, 2024<\/strong><\/em>) declared\u00a0unlawful two policy memos, one by Immigration and Customs Enforcement (ICE) and another by the Department of Homeland Security (DHS). Those memos said that if the U.S. had received credible diplomatic assurances from a third country that deportees would not face persecution or torture, they could be sent there without any extra procedures.<\/p>\n<p><em>\u201c[DHS] has adopted a policy whereby it may take people and drop them off in parts unknown &#8230; and, \u2018as long as the Department doesn\u2019t already know that there\u2019s someone standing there waiting to shoot &#8230; that\u2019s fine,\u2019\u201d he <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mad.282404\/gov.uscourts.mad.282404.241.0.pdf\">wrote<\/a>.<\/em><\/p>\n<p><em><strong>\u201cIt is not fine, nor is it legal.\u201d<\/strong><\/em><\/p>\n<p>Murphy ruled that federal regulations required that illegal immigrants be deported to either their home country, or another country as designated by an immigration judge.<\/p>\n<p>They also have the right to \u201craise a country-specific claim\u201d against being deported to a third country, he wrote.<\/p>\n<p><strong>The case started last March, when four plaintiffs filed a class-action suit after the government tried to deport them to countries other than their home nation, without notice or opportunity to object to their destination.<\/strong><\/p>\n<p>In April, the judge expanded the class of plaintiffs to include anyone with a final removal order to a third country after Feb. 18, 2025.<\/p>\n<p>Murphy blocked those removals on April 18, but on May 21 he found the government had violated his order by removing six individuals to South Sudan in Africa. He ordered the government to provide them with lawyers and hearings on whether they were afraid to live in that country.<\/p>\n<p><strong>In the meantime, the federal government appealed to the Supreme Court, which stayed Murphy\u2019s order in June.<\/strong><\/p>\n<p>In its stay <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24A1153\/359703\/20250527153743499_DHS_v._DVD_et_al-app_stay.pdf\">application<\/a>, the government said the lower court proceedings were \u201cusurping the Executive\u2019s authority over immigration policy,\u201d and \u201c wreaking havoc on the third country removal process.\u201d It characterized some of the deportees as \u201ccriminal aliens who had been in the country for years or decades after receiving final orders of removal, despite having committed horrific crimes,\u201d including sexual assault and murder.<\/p>\n<p>The same day the Supreme Court stayed his April ruling, Murphy issued an order saying his May directive was still in effect, since the government had not included it in their petition. The justices had to issue a follow-up <a href=\"https:\/\/www.supremecourt.gov\/opinions\/24pdf\/24a1153_2co3.pdf\">clarification<\/a> saying it had intended to invalidate both of the judge\u2019s rulings.<\/p>\n<p><strong>In a brief, unsigned order, the majority said Murphy was attempting to use his May directive\u2014granting the deportees lawyers and hearings\u2014to enforce the ruling from April, which he could not do.<\/strong><\/p>\n<p>Justice Elena Kagan, in a short opinion, noted that she didn\u2019t want to halt Murphy\u2019s decision from last April.<\/p>\n<p>\u201cBut a majority of this Court saw things differently, and I do not see how a district court can compel compliance with an order that this Court has stayed.\u201d<\/p>\n<p>Murphy has suspended his own Feb. 25 ruling for 15 days, giving the government time to ask an appeals court to halt it for a longer period.
