Porter of the Eastern District of Virginia<strong> in favor of the press regarding the handling of files and materials taken in a search of the home of a Washington Post reporter. <\/strong><\/p>\n<p><a href=\"https:\/\/cms.zerohedge.com\/s3\/files\/inline-images\/Land_on_the_Moon_7_21_1969-repai.jpg?itok=KSpe0TBm\"><\/a><\/p>\n<p><strong>Judge Porter ruled against the Trump Administration in what he called an \u201cunsupervised, wholesale\u201d search of the files of Hannah Natanson, who covers the federal government for The Post. <\/strong><\/p>\n<p>Instead, the court itself will conduct the review in camera.<\/p>\n<p>In his\u00a0<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.vaed.588772\/gov.uscourts.vaed.588772.62.0_1.pdf\">opinion,<\/a>\u00a0<strong>Judge Porter chastized the Trump Administration for searching Natanson\u2019s home without additional protections for the journalist\u2019s interests in privileged sources<\/strong>. This has been a long-standing objection of the press to the Justice Department, which maintains that its own \u201cfilter teams\u201d can review the files and materials relevant to their investigation and then hand them over to prosecution teams.<\/p>\n<p>The Justice Department was investigating a Maryland government contractor, Aurelio Perez-Lugones,\u00a0<a href=\"https:\/\/www.justice.gov\/opa\/pr\/maryland-man-indicted-unlawful-transmission-and-retention-classified-national-defense\">who has been indicted<\/a>\u00a0on charges of transmitting and retaining classified national defense information.<\/p>\n<p>Judge Porter chastized the government for failing to mention a 1980 law, the Privacy Protection Act, in seeking a search warrant of Ms. Natanson\u2019s home. The PPA mandates that a search for reporting materials \u201cshall be unlawful\u201d unless there is probable cause that the reporter committed certain crimes to which the materials relate. In a prior hearing, Judge Porter asked pointedly, \u201cHow could you miss it? How could you think it doesn\u2019t apply?\u201d<\/p>\n<p><strong>Judge Porter ruled that \u201c[a]llowing the government\u2019s filter team to search a reporter\u2019s work product \u2014 most of which consists of unrelated information from confidential sources \u2014 is the equivalent of leaving the government\u2019s fox in charge of The Washington Post\u2019s henhouse.\u201d<\/strong><\/p>\n<p>The court indicated that the search was too broad and was insufficiently protective of the journalistic interests in the case, noting that the government has a \u201clegitimate interest in only an infinitesimal fraction of the data it has seized.\u201d<\/p>\n<p><strong>The court said it would issue new guidelines for reviewing the material.
