In a letter they intended to send on Tuesday, the pair will argue that it&#8217;s within Bessent&#8217;s authority to make such a move, without the need for legislation,<\/p>\n<p>\u201cUsing your executive authority to \u2026 eliminate an unfair inflation tax on everyday Americans is the single most pro-growth economic action the administration can take unilaterally, and it would boost savings, spur investment, and create jobs nationwide,\u201d Cruz and Scott wrote in the letter reviewed by the\u00a0<em><a href=\"https:\/\/www.washingtonpost.com\/business\/2026\/03\/03\/capital-gains-tax-relief-cruz\/\">Washington Post<\/a>. <\/em><\/p>\n<p><a href=\"https:\/\/assets.zerohedge.com\/s3fs-public\/inline-images\/c66d5dcd-b45e-42b8-90e2-74cf793a0695.jpeg?itok=yCwE27NZ\"><\/a><\/p>\n<p>To appreciate <strong>the injustice of the status quo<\/strong>, consider an investor who paid $10,000 for a stock in January 2010, and sold it for $15,000 in January 2026. On a <a href=\"https:\/\/www.bls.gov\/data\/inflation_calculator.htm\">CPI<\/a> inflation-adjusted basis, the investment has only grown by $10.22 in real terms. However, the investor is forced to pay tax on a supposed gain of $5,000.\u00a0By <a href=\"https:\/\/atr.org\/wp-content\/uploads\/2026\/02\/Coalition-to-Index-Capital-Gains-Tax-Final.pdf\">some<\/a> estimates, <strong>a third of all unrealized capital gains represent the effects of inflation<\/strong>.\u00a0<\/p>\n<p><strong>&#8220;American families and job creators should not have to pay taxes on phantom income,&#8221;\u00a0<\/strong>said a group of more than 30 conservative organizations and individuals in a <a href=\"https:\/\/atr.org\/wp-content\/uploads\/2026\/02\/Coalition-to-Index-Capital-Gains-Tax-Final.pdf\">letter<\/a> to President Trump last month. &#8220;Our tax brackets are indexed to inflation for a reason\u2014we don&#8217;t think a worker who gets a raise that barely keeps pace with inflation should face a tax increase. The same principle should apply to savings.\u00a0<\/p>\n<p>In their letter to Bessent, the two senators also argue that <strong>capital gains tax relief can also help ease the woes of America&#8217;s pricy housing market<\/strong>, pointing to people who have large unrealized gains on their homes, making them reluctant to sell. Last month, Americans for Tax Reform said, &#8220;The Treasury Department has the authority to redefine the calculation of capital gains taxes by excluding inflation from tax owed, based on several\u00a0<a href=\"https:\/\/atr.org\/sites\/default\/files\/assets\/1993%20Memo-%20The%20Legal%20Authority%20of%20the%20Department%20of%20the%20Treasury%20to%20Promulgate%20a%20Regulation%20Providing%20for%20Indexation%20of%20Capital%20Gains.pdf\">legal<\/a>\u00a0<a href=\"https:\/\/atr.org\/sites\/default\/files\/assets\/2012%20Memo%20-%20The%20Regulatory%20Authority%20of%20the%20Treasury%20Department%20to%20Index%20Capital%20Gains%20for%20Inflation%20-%20A%20Sequel.pdf\" target=\"_blank\">analyses<\/a>\u00a0going back several decades.&#8221; Skeptics point to a\u00a01992 conclusion of the Justice Department\u2019s Office of Legal Counsel\u00a0that said such a move would exceed the department&#8217;s authority.\u00a0<\/p>\n<p>As they are prone to do with most tax-cut proposals, <strong>leftists whine that most of the benefit of a capital gains indexing would accrue to the wealthiest taxpayers &#8212; but that&#8217;s because they&#8217;re hardest hit by the current structure.<\/strong> For 2026, unmarried taxpayers with taxable income under $49,450, and married taxpayers with income under $98,900, have <a href=\"https:\/\/taxfoundation.org\/data\/all\/federal\/2026-tax-brackets\/\">a 0% capital gains rate<\/a>. The rate rises to 15% for those with taxable income under $545,500 for unmarrieds and $614,700 for married couples. Beyond that, the rate is 20%.
