NTD<\/em><\/a><\/p>\n<p>The Centers for Medicare and Medicaid Services (CMS) last month temporarily deferred $259 million in Medicaid funds to Minnesota over alleged fraud in the state\u2019s program, according to the court filing.<\/p>\n<p>The <a href=\"https:\/\/www.ag.state.mn.us\/Office\/Communications\/2026\/docs\/01701_Oz_Complaint.pdf\">lawsuit<\/a>, filed by Minnesota Attorney General Keith Ellison and the state\u2019s Human Services Department, a<strong>sked the court to block the withholding of $243 million of those funds that were tied to 14 services<\/strong> the government identified as \u201chigh-risk\u201d and subject to \u201cnoncompliance action.\u201d<\/p>\n<p>\u201cThese cuts are the latest in a long series of efforts to go around the law to punish Minnesotans \u2014 but just as we fought back and won when they illegally tried to cut funding for childcare, hungry families, and our schools, we are suing them again today to make them follow the law,\u201d Ellison said in a statement.<\/p>\n<p><strong>The suit called the funding freeze unlawful, alleging that the government used the program as \u201cpolitical punishment\u201d against the state<\/strong>, citing its previous attempts to withhold other funding from the state, including funds tied to the Supplemental Nutrition Assistance Program (SNAP).<\/p>\n<p>According to the lawsuit, the federal government announced in January that it would freeze more than $2 billion in annual Medicaid funding to Minnesota over allegations of noncompliance.<\/p>\n<p>The state appealed but said the federal government has not clarified the alleged conduct it deemed noncompliant or how Minnesota can remedy the issue.<\/p>\n<p>\u201c<strong>Impatient that it cannot withhold the $2 billion until Minnesota is provided a hearing and other due process, the administration \u2018deferred\u2019 $243 million from the state on February 25, 2026<\/strong>,\u201d it stated.<\/p>\n<p>The lawsuit is seeking a temporary restraining order to block the funding freeze, saying the withholding of funds would affect more than 1 million Minnesota residents enrolled in Medicaid.<\/p>\n<p>\u201cUnless the deferral is quickly reversed, the state will be irreparably harmed. The administration has already stated that the deferral will recur every quarter, crippling the state budget,\u201d it stated.<\/p>\n<p>The lawsuit names the Department of Health and Human Services and the Centers for Medicare and Medicaid Services, as well as Dr. Mehmet Oz, in his official capacity as CMS administrator, and Robert F. Kennedy Jr., in his official capacity as health secretary.<\/p>\n<p>CMS said it does not comment on litigation.<\/p>\n<p>John Connolly, deputy commissioner of the Minnesota Department of Human Services and state Medicaid director, said <strong>the state has invested \u201cmassive effort and resources\u201d to address fraud in the program.<\/strong><\/p>\n<p>Medicaid is known as Medical Assistance in Minnesota. A family of four may qualify for the program if their income does not exceed $42,759, according to the state attorney general\u2019s office.<\/p>\n<p>Vice President JD Vance said on Feb. 25 that the government halted Medicaid funds to Minnesota to ensure that the state \u201ctakes its obligations seriously to be good stewards of the American people\u2019s tax money.\u201d<\/p>\n<p>\u201cA lot of people are getting rich off the generosity of American taxpayers. But more fundamentally and more importantly than that, it means that there are kids in Minnesota who deserve these services, who need these services. And they\u2019re not going to those kids; they\u2019re going to fraudsters in Minneapolis,\u201d he said.<\/p>\n<p>\u201cThat is unacceptable.
